RESOLUTION OF IDTTENTION IPS THE MATTER OF THE
IMPROVEMENT OF DUNCAN AVENUE ET AL BY TFIE
CONSTRUCTI0I1 OF CONCRETE CURPS APdD GUTTERS,
TOGETHER WITH ALL IPdCIDENTAL AND APPURTENAIJT
WORK.
' WHEREAS, pursuant to the provisionw of Division IV of
the Streets and Highways Code, cited as a Special AsNessment
' Investigation Limitation and Majority Protest Act of 1g31, the
' City Council of the Czty of Lynwood has determined that Duncan
Avenue, between Fernwood Avenue and Lavinia Avenue, and porfionu
- of Fernwood Avenue, east and west of Dunean Avenue, and portion�
of Josephine Street, east and west of,Duncan Avenue, and portions
of Lavinia Avenue, east of Duncan Avenue, as proposed in Re�olution
No. 66-68 of said city is feasible, and that the public interest,
convenience, and necessity require the improvement substantially
a� set forth in said report, and saia City Council has found that
, the lands to be aNsessed will be able to stand the burden of the '
proposed assessment;

the City of Lynwood as £ollows;
Section l . That in the opinion of the City Council of
the City of Lynwood, the public intereat and o�nvenience require
and it is the intention of said City Council to order the following
work or improvement to be done to wit:
The construction of cement concrete curb and gutter and
drive approaches, including all incidental and appurtenant work on
Duncan Avenue, between Fernwood Avenue and Lavinia Avenue, and on
the eouth side of Fernwood Avenue 161.8 feet east and west of Duncan
Avenue, and on the north side of Josephine Street 160 feet west and
110 feet eaut of Duncan Avenue, and on the �outh side of Josephine
Street 320 feet we�t and 110 £eet east of Duncan Avenue, and on the
north side of Lavinia Avenue 206.65 feet eaet of Duncan Avenue.

All of said work or improvement shall be performed in
the public ways and befween the lim'its'hereinafter tief,ore designated,
except when the plans indicate that the„work shall be omitted.
That all of the work or improvement aforesaid shall be
done and performed in accordance with to the grades shocdn on
the plans and Specifications No. 1966-H-3, on fi�le in the office
of the.City Clerk of said city.. Said plans are hereby referred to
� for a.full and complete description of said propoaed work and for'
the grades to which the work is to be done, and said plans and .
specificatzons are by reference made�part hereof and shall govern -

for all detail of the proposed work.
That the total'estimated cost of said work or improvement
is the sum of'�12, 884.40.� The City of Lynwood will contribute
�5 ,218.97. The total e�timated cost to the property ownera is
$7, 665 . �+3. i �
' Section 2 . That said contemplated work or improvement,

in the opinion of the Gity Council, isof more than local or �
"`` "ordinary pu'b1ic--benefit; and said Cit,y Council hereby determines'
and deelares that the district to be benefited by said work or
, improvement, and to be assessed to pay the cost and expenses o£
such work or improvemenf, is...shown on Plan No. 1g66-H-3, on file
in the office of the City Clerk of sa,id city, to which reference _
is made for a full and complete description of the assessment
' district.. .
Section 3 . The City Council determines and declarev�
tha.t serial bonds �hall be issued•in the manner and form provided
• in Division VII, of the Streets and Highways Code, cited as the
:Improvement Act of l�ll,. ae amended, bearing interewt at the rate
o£ 6% per annum, to represent each a�sessment of $50.00 or over .
remaining unpaid £or thirty days after date o£ recordation of the
warrant .

Section 4 . ISotice is hereby given that the provisions
of that certain act of the Legislature of the State of California,
designated as the Streets and Highways Code, Division IV, cited a.e
a Special Assessment..Investigation Limitation and Majority Proteat
Act of 1931, aw amended, haw heret,ofore been'fully complied with
and the reports required under the pxovisions of said act, are
cn file in the office of. the City Clerk of said city, open to public
� inspectiorn and may there be examined by all interested persons.
Section 5 . The proceedings for the aforesaid work or
improvement shall be taken under an act of the legislature of the
State of California designa.ted as the Streets and Highways Code,
Division VII, cited as the Improvement Act of 1911 and amendments
thereto. • •
. Section 6 . The City Engineer is hereby directed to make
a diagram of the property a£fected or beriefited by said proposed
work or improvement, as described herein, and to be assessed to pay
the cost and expenses of said work showing each separate lot, piece,
' or parcel:of land and the dimensions of each 1ot,_ piece, or parcel
of land, and the rela.tive location of the same to the work or
improvement proposed to be done, all within the limits of'said
assessment district. •
Section 7 . Tlotice is hereby given that on Tuesday, the

Chambers in the City Hall, 11330 Bullis Road, in t�e City of
Lynwood, any and all pertions having any objections or protests to

to be assessed, or to the grades to which the work is proposed to
' be done, ma,y appear before eaid City Council and show cause why_
said proposed work or improvement should not be carried out in
accorda.nee with this resolut•ion.

Section 8 . The City Engineer, who is the Superintendent
of Streets, is hereby directed to post notices of the passage of
this resolution in the time, form, and manner required by law.
Section 9 . The City Clerk shall certify to the passage
of this resolution by the City Council o£ said City of Lynwood
and cause the same to be published twice in the Lynwood Press, a
newspaper published and circulated weekly in said city, and
� hereby desi�nated by said City Council 1'or the purposes aforesaid.
Said clerk is also directed to mail notices of the adoption of
thia resolution and intention in the time, form, and manner, and
to the persons all as provided in said improvement act of 1911,
as amended.
