Mayor Chavez called the Regular City Council meeting to order at 7:32 p.m. 2. ROLL CALL PRESENT: Councilmember-Man, Sternquist, Yu, Chavez ABSENT: Councilmember-Fish ALSO PRESENT: City Manager Cook, City Attorney Vail, City Clerk Kuo, Administrative Services Director Hause, Community Development Director Forbes, and Planning Manager Reimers Mayor Pro Tem Yu made a motion to excuse Councilmember Fish for cause. Seconded by Councilmember Sternquist. 3. INVOCATION Lynne Best from Westminster Presbyterian Church provided the Invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #174 provided a flag ceremony and led those present in the Pledge of Allegiance. 5. CEREMONIALIPRESENTATIONS A. PET OF THE MONTH Diane Rios, San Gabriel Humane Society volunteers, introduced the featured pet for the month "Little Guy", an 8 year old male Chihuahua Mix. Little Guy qualifies for the Senior for Senior Adoption Program. Those interested in adopting him can call the San Gabriel Valley Humane Society at (626) 286- 1159. B. BICYCLE BOULEVARDS Community Development Director Forbes provided a brief review of the City's adopted Bicycle Master Plan and the planned bike routes recently installed City Council Minutes January 5, 2016 Page 2 of 9 throughout the city. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Steve Stafford, Temple City resident, spoke regarding a development at 5424 Temple City Boulevard. David McGrath, Temple City resident, expressed safety concerns and home burglaries in his neighborhood. Franklin Ruedel, Temple City resident, commented regarding the bicycle lanes throughout the City. 7. CONSENT CALENDAR Mayor Chavez pulled Consent Calendar Item B. Mayor Pro Tem Yu made a motion to approve the remammg items on the consent calendar except Item B. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the Special City Council Meeting of December 15, 2015; 2) Minutes of the Regular City Council Meeting of December 15, 2015; and 3) Minutes of the Special City Council Meeting of December 16, 2015. Action: Approved. C PETTY CASH REPORT The City Council is requested to review, receive and file the Petty Cash Report. Action: Received and filed report. City Council Minutes January 5, 2016 Page 4 of 9 Development Block Grant funds allocation for Fiscal Year 2016-17. Mayor Chavez opened public comment. Jerry Jambazian, Temple City business owner, asked questions regarding the Lead and Asbestos Abatement Program. Hearing no further request to speak, Mayor Chavez closed public comment. Councilmember Man made a motion to authorize the City Manager to amend CDBG-funded program allocations up to 50 percent of the approved allocation; and consider adopting the staff recommended CDBG-funded programs and allocations for FY 2016-17. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 16-1008 AMENDING SECTION 9-1T-7 OF THE TEMPLE CITY MUNICIPAL CODE PERTAINING TO MEDICAL MARIJUANA FACILITIES AND ACTIVITIES The proposed Zoning Code amendment would continue City's policy in express terms to avoid a piecemeal regulatory approach and ensure that all medical marijuana facilities and activities are expressly prohibited. Community Development Director Forbes gave a summary of the staff report. City Council commented and discussed regarding the ordinance amending the City's Municipal Code pertaining to medical marijuana facilities and activities. Mayor Chavez opened public comment. Hearing no request to speak, Mayor Chavez closed public comment. Mayor Pro Tern Yu made a motion to introduce Ordinance No. 16-1008 for first reading by title only, amending Section 9-1T-7 of the Temple City Municipal Code pertaining to medical marijuana facilities and activities, waive further reading of Ordinance No. 16-1008, and schedule the second reading of the ordinance for January 19, 2016. ADOPTION OF URGENCY ORDINANCE NO. 16-1011U AND INTRODUCTION AND FIRST READING OF ORDINANCE NO. 16-1012 REGULATING WIRELESS COMMUNICATION FACILITIES AND TELECOMMUNICATION FACILITIES IN THE PUBLIC RIGHT OF WAY The proposed ordinance is divided into two main pieces: telecommunications facilities in the public right of way and wireless communication facilities not in the public right of way. Community Development Director Forbes gave a brief summary of the staff report. City Council commented and discussed regarding the Urgency Ordinance and Ordinance regulating wireless communication facilities and telecommunication facilities in the public right of way. Mayor Chavez opened public comment. Steve Stafford, Temple City resident, spoke against the light pole wireless structure option. Hearing no further request to speak, Mayor Chavez closed public comment. Mayor Pro Tern Yu made a motion to introduce, read by title, waive further reading, and adopt Urgency Ordinance No. 16-1011U adopting section 6-4A and o-1T-8 and amending section 9-1 F-10 of the Temple city Municipal Code relative to Wireless Communication Facilities. Seconded by Councilmember Sternquist and approved by the following votes: AYES: ABSTAINED: NOES: ABSENT: Councilmember: Man, Sternquist, Yu, Chavez Councilmember: None Councilmember: None Councilmember: Fish Mayor Pro Tern Yu made a motion to introduce for first reading by title only and waive further reading Ordinance No. 16-1012 adopting section 6-4A and 9-1T-8 and amending section 9-1F-10 of the Temple City Municipal Code relative to Wireless Communication Facilities; adopt the Negative Declaration as the environmental clearance for the proposed Ordinances; and schedule the second reading of Ordinance No. 16-1012 for January 19, 2016. El Nino Update City Manager Cook reported on the condition of City streets and inspection of flood prone areas in the City. Staff will check storm drains tomorrow and continue to collaborate with all agencies to plan for the El Nino storm. B. Community Events City Manager Cook invited the public to attend a Parks and Recreation Community Meeting on January 7, 7 p.m. 13. UPDATE FROM CITY ATTORNEY City Attorney Vail reported on Senate Bill 450 which was introduced in 2015 authorizing a county, on or after January 1, 2018, to conduct any election as an all- mailed ballot election if certain conditions are met. City Attorney Vail will provide another update regarding the Senate Bill as more information becomes available. 14. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS A. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Mayor Chavez and Councilmember Fish)-Formed 1/3/2012 No report. B. COUNCILMEMBER MAN Shared that the deadline to sign up for the Citizen's Academy has been extended and encouraged the public to sign up. C. COUNCILMEMBER STERNQUIST Shared that the Metroplitan Water District is giving away rain barrels. She encouraged the pubic to learn more about it. D. MAYOR PROTEM YU Commented on the work staff is doing to keep the catch basins clear of debris citywide. E. MAYOR CHAVEZ Concurred with Mayor ProTem Yu regarding the importance of keeping the catch basins clear of debris during the rain season. 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jim White, Temple City resident, spoke regarding the Las Tunas Drive Improvement Project and the options that were considered at the December City Council Minutes January 5, 2016 Page 9 of 9 Community Meeting. 18. ADJOURNMENT Mayor Chavez adjourned the meeting at 9:21 p.m. in memory of Patricia Hanft who passed on 12/20/2015. Mrs. Hanft and Mr. Hanft were instrumental in designing the entrance sign to Temple City, the TC flag and logos for Chamber of Commerce, Camellia Festival, Temple City Unified School District and Historical Society.
