HomeMy Public PortalAbout2003-18 - AMENDMENT - ZINC MILL PARK PLANNED UNIT DEVELOPMENTORDINANCE N0. 2003 - AN ORDINANCE AMENDING ORDINANCE 2000 -25 - AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE CREATING THE ZINC MILL PARK PLANNED UNIT DEVELOPMENT WHEREAS, the Greencastle Plan Commission and Greencastle Common Council adopted Ordinance 2000 -25 "An Ordinance Amending the Greencastle Planning and Zoning Ordinance Creating the Zinc Mill Park Planned Unit Development" on December 12, 2000 in conjunction with the development of Phase 1 of the Planned Unit Development; WHEREAS, the Rena Corporation (Harry A. Jones) has prepared this ordinance to amend Ordinance 2000 -25 which created the Zinc Mill Park Planned Unit Development to accommodate the development of Phase 2 of the Planned Unit Development; WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on September 22, 2003, after a timely notice of the ® hearing was given by publication in the Banner- Granhlc Greencastle, Indiana, on September 12, 2003; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard tot he following factors enumerated in I.C. 36 -74-603 in consideration of the ordinance and determination of a recommendation to be made to the Common Council: the comprehensive plan; 2. current conditions and the character of current structures and uses in each district; 3. the most desirable use for which the land in each district is adapted; 4. the conservation of property values throughout the jurisdiction; and 5. responsible growth and development. WHEREAS, the Greencastle Plan Commission has certified this ordinance to the Common Council with a recommendation by a majority vote in favor of adoption; WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in I,C. 36 -7 -4-603 before acting on this ordinance; " WHEREAS, the Common Council has determined that this ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. THEREFORE, BE IT ORDAINED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA: That the following additions and amendments to Ordinance 2000 -25 - An Ordinance Amending the Greencastle Planning and Zoning Ordinance Creating the Zinc Mill Park Planned Unit Development be made: Addition and Amendment to "Schedule 1 - Zinc Mill Park Planned Unit Development - Permitted Uses" Add "nursing home /assisted living center" as a permitted use on lots 8, 9, and 10. 2Addition and Amendment to "Schedule 2 - Zinc Mill Park Planned Unit Development - Minimum Required Parking Spaces" Add "nursing home /assisted living center' to the list of permitted uses. Add 1 space per employee on the largest shift + 1 resident space per 3 assisted � living units + 1 guest space per 5 nursing beds + 1 guest space per 3 assisted living units" Amendment to "Property Development Standards (item k) Vehicle Entrances" found on page 6 of the ordinance. For each of lots 9, and 10, delete the existing information and replace with the following new information: Lot Number of Number Entrances Type Street Location 9 One 10 One Shared two way with Lot 10 Shared two way with Lot 9 Avenue F Avenue F That the documentation governing the Zinc Mill Park Planned Unit Development be amended to reflect these changes. That this ordinance takes effect upon passage, That the Clerk- Treasurer of the City of Greencastle is ordered to have this ordinance published by inserting a copy of the ordinance in each of the two (2) sets of the City of � Greencastle Code maintained on file for public inspection in the office of the Clerk - Treasurer. Jones) 11 ® GREENCASTLE CITY PLAN COMMISSION DOCKET NO. 2003 - P9.02 Amendment to Ordinance 2000.25 "An Ordinance Amending the Greencastle Planning and Zoning Ordinance Creating the Zinc Mill Park Planned Unit Development" to allowfora new permitted use, additional parking requirements, and revised entrance drive requirements In the Zinc Mill Park Planned Unit Development. This property Is commonly known as the former Ball Brothers Zinc Mill site and Phase 2 of the Zinc Mill Park Planned Unit Development. Petitioner: The Rena Corporation (Harry A. GREENCASTLE PLAN COMMISSION go Presiding Officer ATTEST: Secretary ® Summary of Requested Changes to the Zinc Mill Park Planned Unit Development The following changes are requested to be made to Ordinance 2000 -25 - An Ordinance Amending the Greencastle Planning and Zoning Ordinance Creating the Zinc Mill Park Planned Unit Development. These changes reflect the proposed nursing home projectfor lots 8, 9 and 10. All other requirements of the ordinance will remain in place. No changes are proposed that affect lots 6 and 7. 1. Addition and Amendment to "Schedule 1 - Zinc Mill Park Planned Unit Development - Permitted Uses" Add "nursing home /assisted living center" as a permitted use on lots 8, 9, and 10. Discussion: Specifically adding this permitted use correctly reflects the nature of the proposed project rather than classifying it as a "health related facility." A "health related facility" is listed as a permitted use for lots 8, 9, and 10 in the existing ordinance. 2. Addition and Amendment to "Schedule 2 -Zinc Mill Park Planned Unit Development - Minimum Required Parking Spaces" E. Add "nursing home /assisted living center" to the list of permitted uses. Add "1 space per employee on the largest shift + 1 resident space per 3 assisted living units + 1 guest space per 5 nursing beds + 1 guest space per 3 assisted living units" Discussion: Using the proposed formula with an employee count of 35 on the largest shift, 68 nursing beds, and 40 assisted living units, provides a requirement for a total of 77 parking spaces (Partial spaces were rounded up). The new city zoning ordinance requires one parking space per employee on the largest shift and one per three nursing beds. Counting the 35 employees and a count of 108 nursing and assisted living beds results in a required parking count of 71 spaces. The 77 spaces provided falls within the range of experience of the developer based on similar projects. Calculation summary: 35 employees on largest shift 1 to 1 ratio 40 assisted living units - residents 1 to 3 ratio 68 nursing beds - guests 1 to 5 ratio 40 assisted living units - guests 1 to 3 ratio 35 spaces 14 spaces 14 spaces 14 spaces Total: 77 spaces ® 3. Amendment to "Property Development Standards - Item k. Vehicle Entrances" found on page 6 of the ordinance. For each of lots 9 and 10, delete the existing information and replace with the following new information: Lot Number of Number Entrances Type Street Location 9 One 10 One Shared two way with Lot 10 Shared two way with Lot 9 Avenue F Avenue F Discussion: The change in the entrances reflect the street and lot layout in the proposed Phase 2 which differs from the original concept for Phase 2 that was proposed three years ago. •
