Member Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-41
RESOLUTION GRANTING FINAL APPROVAL TO THE
PLAT OF FOXBERRY FARMS 6TH ADDITION
WHEREAS, Lundgren Bros. Construction, Inc. (the "Applicant") has requested approval to
plat certain property in Medina generally located west of Co. Rd. 116, north of T.H. 55 and south of
Hackamore Road (the 'Property"); and
WHEREAS, portions of the Property have been designated and previously platted as
Foxberry Farms, Foxberry Farms 2nd Addition, Foxberry Farms 3rd Addition, Foxberry Farms 4th
Addition and Foxberry Farms 5th Addition; and
WHEREAS, the Applicants have proposed to replat Outlot P, Foxberry Farms into an
additional 171ots as Foxberry Farms 6th Addition; and
WHEREAS, the final plat has been submitted to and reviewed by the city and found to be
consistent with all requirements of previous approvals and city ordinances.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that final approval is hereby granted to the Applicants for the plat of Foxberry Farms 6th
Addition, subject to the following:
1. No lot within the approved plat may be developed with a single family home or
accessory use until Lundgren Bros. Construction, Inc. and the city have executed a
development agreement regarding said lot;
2. Final approval of this plat is conditional upon a favorable report on the condition of
title from the city attorney;
3. The Applicants must file the final plat with Hennepin county within 60 days of the
date of this resolution or the approval granted hereby shall be considered null and
void; and

4 The Applicants must pay to the city a fee in an amount sufficient to reimburse the
city for its costs and expenses in reviewing the plat, including the cost of preparing
and negotiating the development agreement.

The motion for the adoption of the foregoing resolution was duly seconded by member Zietlow and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Smith, and Zietlow
and the following voted against same: None Absent: Johnson
Whereupon said resolution was declared duly passed and adopted.
