HomeMy Public PortalAbout1999-04295 Member Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESONUTION NO.99-42 RESOLUTION GRANTING FINAL APPROVAL TO THE PLAT FOR DOUG MALIKOWSKI AND THOMAS KELLY WHEREAS, Douglas and Alicia Malikowski and Thomas and Claudia Kelly (the "Applicants") are the fee owners of property located at 1152 Navajo Road and 3132 Tamarack Drive, respectively; and WHEREAS, the Applicants wish to plat their properties to effect a transfer of land from the Kellys to the Malikowskis; and WHEREAS, this matter has been reviewed by the planning commission at its meetings on May 11, 1999 and June 8, 1999; and WHEREAS, this matter has been reviewed by the city council at its meeting on May 18, 1999 and June 15, 1999. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that final plat approval be granted to the Applicants subject to the following terms and conditions: 1. It is recognized that the new lot lines will not compromise the 150' setback for the existing barns on the Mailkowski property. 2. The Applicants must pay to the city an administrative fee in an amount necessary to reimburse the city for the cost of reviewing this application; and 3. The Applicants must file the final plat with Hennepin County within 60 days of the date of this resolution or the approval hereby granted shall be null and void. RHB-165207 99-42 ME230-296 07-06-99 96 NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that variances are approved with regard to the soil requirements for the subject plat to allow the Kelly property to be reduced in size from 10.1 acres with 3.1 acres of conventional soils to 9.93 acres with 2.9 acres of conventional soils, and the Malikowski property to be increased from 10.21 acres with 3 acres of conventional soils to 10.38 acres with 3.2 acres of conventional soils, which variances are justified by the following hardships: 1. The moving of the lot lines will not impact future septic sites; 2. The plat is not creating any new parcels; and 3. The new lot lines will more closely follow natural site features.
