BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council hereby accepts the dedication of the Christy Drive Extension as set forth in the attached Appendix A, which is incorporated herein as if more fully and completely set forth, and the Mayor and City Clerk are hereby authorized to execute the same. Section 2. In compliance with the development agreement entered into between Land Investments LLC and the City of Jefferson, the Council does hereby authorize the payment of the sum of Four Hundred Fifty Thousand and no/100 Dollars($450,000.00)to Land Investments LLC in exchange for the dedication of said Christy Drive Extension. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: r.l dy' 2008 Approved: �e� 3 2 g r siding Officer Mayor ATT APPROVED A TO FORM: 4itye k City ou selor COOPERATIVE AGREEMENT BETWEEN THE CITY OF JEFFERSON, MISSOURI,AND THE COUNTY OF COLE,PURSUANT TO CHAPTER 70, REVISED STATUTES OF MISSOURI,REGARDING CHRISTY DRIVE EXTENSION This Cooperative Agreement is made and entered into by and between the City of Jefferson, Missouri, a municipal corporation(hereinafter referred to as City), and the County of Cole, Missouri (hereinafter referred to as County)pursuant to the provisions of Chapter 70 of the Revised Statutes of Missouri, and shall be effective as of the date last executed by City or County. Whereas, City has or will shortly hereafter enter into a Development Agreement with Land Investments, L.L.C., a Missouri limited liability company(hereinafter referred to as the Developer), for the construction of an extension of Christy Drive from its present terminus to its proposed intersection with State Route B, which extension shall be according to the terms and conditions of said Development Agreement(said Christy Drive extension being hereinafter referred to as the Project); and Whereas, the Project is not naturally competitive inasmuch as the Project will be constructed over and across property currently owned by Developer, with Developer contributing approximately$1,700,000.00 to the Project,and therefore the Project is not required to be publicly bid; and Whereas, the Project is a part of the Jefferson City Area Roadway Improvement Summary dated September, 2003, and specifically Exhibit 2 thereof, and will benefit the overall transportation facilities of the City and County; Now,therefore, it is agreed as follows: County agrees to reimburse the City for a portion of the overall costs of the Project in the amount of$350,000.00, to be paid by the County to the City upon acceptance by the City of that portion of the street extension located in the City.
