Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-43
RESOLUTION GRANTING FINAL APPROVAL FOR THE
PLAT OF ELM CREEK KNOLL
WHEREAS, Gary Boster, Roger Kullander and Carol J. Kullander (collectively, the
"Applicants") are the fee owners of land in Medina located generally south of Hamel Road and east
of the southerly projection of Pinto Drive (the "Subject Property"); and
WHEREAS, the Applicants have previously received preliminary approval to plat the
Subject Property into seven lots for the purpose of constructing townhouses thereon; and
WHEREAS, the Applicants have applied for final approval of the plat of Elm Creek Knoll;
and
WHEREAS, this matter has been reviewed by the staff and city council for compliance
with the ordinances of the city and the terms and conditions of preliminary plat approval.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that final approval be granted to the Applicants for the plat of Elm Creek Knoll, subject
to the following terms and conditions:
1. The Applicants must establish and maintain a homeowners' association to which all
lot owners belong, which association shall provide for maintenance of all common
elements within the plat, including the N.U.R.P. pond on Outlot A;
2. The Applicants must install an additional fire hydrant on the line between proposed
lots 2 and 3;
3. The plat must be approved by the Elm Creek Watershed District;
4. The Applicants must pay to the city a park dedication fee in the amount determined
by the city assessor;
5. The Applicants must install a stop sign at the intersection of Pinto Drive and Hamel
Road;

6. The Applicants must ensure that at least two trees a minimum of 2" in diameter are
planted on each lot prior to occupancy of the dwelling;
7. The Applicants must execute a site improvement agreement satisfactory to the city
attorney to ensure completion of all necessary site improvements;
8. The Applicants must pay the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing this application; and
9. The Applicants must file the plat with Hennepin County within 60 days of the date
of this resolution or the approval hereby granted shall be null and void.

The motion for the adoption of the foregoing resolution was duly seconded by member Johnson
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
