Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-45
RESOLUTION GRANTING SETBACK VARIANCES TO JIM
AND MARGARET KELLY FOR CONSTRUCTION OF A
HOUSE AT 2959 LAKESHORE AVENUE
WHEREAS, Jim and Margaret Kelly (the "Applicants") are the fee owners of property
located at 2959 Lakeshore Avenue (the "Property"); and
WHEREAS, the Applicants wish to construct a single family detached house on the
property; and
WHEREAS, construction of the proposed house will require a reduction in front yard
setback from 30 feet to 25 feet and a reduction in the rear yard setback from Lake Independence
from 75 feet to 45 feet; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on June
8, 1999 and by the city council at its meeting on June 15, 1999; and
WHEREAS, it has been determined that the requested variances will not adversely impact
development of adjacent property for the purpose for which they are currently zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that the above described setback variances are hereby granted to the Applicants for the
Property, subject to the following terms and conditions:
1. The Applicants must remove the existing improvements on the Property prior to
initiation of construction of the new house;
2. The new house must be constructed in substantial conformance with the plans and
descriptions provided to the city by the Applicants;

3. The Applicants must pay to the city an administrative fee in an amount necessary to
reimburse the city for its expenses in reviewing this application; and
4. The Applicants must begin construction of the new house on the Property within
one year of the date of this resolution or the variances hereby granted shall be null and void.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota, that the above described setback variances are justified by the hardships
presented to the Applicants by the small size of the lot and the fact that additional property cannot
be added to increase the size of the parcel. It is also noted that the variances requested are
consistent with neighborhood standards and similar to those enjoyed by other properties in the
vicinity.

The motion for the adoption of the foregoing resolution was duly seconded by member Johnson
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
