Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-46
RESOLUTION GRANTING SETBACK VARIANCES TO
FRANCIS AND PAULA BROGHAMMER FOR
CONSTRUCTION OF A HOUSE AT 2961 LAKESHORE
AVENUE
WHEREAS, Francis and Paula Broghammer (the "Applicants") are the fee owners of
property located at 2961 Lakeshore Avenue (the "Property"); and
WHEREAS, the Applicants wish to construct a single family detached home on the
Property; and
WHEREAS, construction of the proposed house will require reduction of the front yard
setback from 30 feet to 19.4 feet, reduction of the south side yard setback from 10 feet to 5 feet, and
reduction of the rear yard setback from Lake Independence from 75 feet to 43 feet; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on June
8, 1999 and by the city council at its meeting on June 15, 1999; and
WHEREAS, it has been determined that the construction of the proposed house on the
Property will not adversely impact the development of adjacent properties for the purpose for which
they are currently zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that the above described setback variances are hereby granted to the Applicants for the
Property, subject to the following terms and conditions:
1. The Applicants must remove all existing improvements on the Property prior to
beginning construction of the new house;
2. The new house must constructed in substantial conformance with the plans and

descriptions provided by the Applicants to the city;
3. The Applicants must pay to the city an administrative fee in an amount necessary to
reimburse the city for its costs in reviewing this application; and
4. The Applicants must begin construction of the new house on the Property within
one year of the date of the adoption of this resolution or the variances hereby granted shall be null
and void.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota, that the variances hereby granted are justified by the hardships to the Property
presented by the small size of the lot, its narrowness, and the fact that there is no additional property
which may be added to increase the area of the lot. In addition it is noted that the variances hereby
granted are similar to those enjoyed by other properties in the neighborhood and are consistent with
neighborhood standards.

The motion for the adoption of the foregoing resolution was duly seconded by member Johnson
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
