WHEREAS, The City of Opa-locka City Commission authorized the issuance of an Request For Proposal No.: 15-150610 for the sale of surplus City owned property; and WHEREAS, The City required a minimum bid and proposal for how the property would be developed; and WHEREAS, Accurate Real Estate Investments Group, LLC & Right Track Investment Group, LLC, have agreed to develop as per the zoning permitted use; and Resolution No. 15-9078 WHEREAS,The City Manager recommends the acceptance of the bids; and WHEREAS, The City Manager needs the authority to execute all necessary closing documents and in order to effectuate the sale and transfer of the surplus property set forth in resolutions herein; and WHEREAS, The seller's, settlement and title documents must be prepared and clear title to property must be conveyed, and an attorney is needed to perform such services. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference; Section 2. The City Commission hereby authorizes the City Manager to accept the bids from Accurate Real Estate Investments, LLC & Right Track Investment Group, LLC, of $11,000.00, for the City-Owned parcel identified by folio 08-2122-007-1041, located in the on West Superior Street; and the bid of $5,374.80, $3,500.30 for the vacant City-Owned parcels, identified by folio 08-2122-003-1420, 08-2122-003-1430, located on the North side of Ali baba Avenue and East of Duval Street; and the bid of $72,187.50; $29,062.00; $29,062.00 and $48,125.00 respectively for the vacant City-Owned parcels, identified by folio 08-2122-003-2330; 08-2122-003-2340 08-2122-003-2350 and 08-2122-003-2360, located on the South side of Ali baba Avenue, and East of Johnson Street. Section 3. The City Manager is hereby authorized to execute all necessary closing documents in order to effectuate the sale and transfer of the surplus property set forth herein; and City Attorney is hereby authorized to prepare the title and seller's documents. Description: The City of Opa-locka issued a Request for Proposal No. 15-1506100 for the Sale of City Owned Surplus Property. The City provided a list of properties that were available. The City required a minimum bid amount and required that the bidder provide a proposal of how the land would be developed and an indication of the time frame for development. Accurate Real Estate Investments, LLC; Right Track Resolution to Accept the Bid for Surplus Property-Bid Notice#1,4,5-A Investment Group, LLC, has submitted a bid total of $198,311.60 for 7 properties identified by folios: 08- 2122-007-1041, 08-2122-003-1420, 08-2122-003-1430, 08-2122-003-2330; 08-2122-003-2340 08-2122- 003-2350 and 08-2122-003-2360, and has agreed to develop these vacant parcels according to the permitted uses of their specific zoning districts within 2 years. Therefore the legislation must reference the following stipulations: (1) The proposed project for the properties must have an agreement between the City and the Developer; (2) There must be a reference in the language in the developer's agreement regarding a timeline or deadline for building plan/permit submission, and for the completion of the project to certificate of occupancy, etc. (3) the developer forfeits the deposit and/or other project related expenditures should the developer decide to not build or develop as agreed; (4) There must be a reverter clause for the property to be returned to the City if the developer does not adhere to timeline and or meet obligations for development. Financial Impact: There is a positive financial impact to the City to approve this resolution.
