Member Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-49
RESOLUTION GRANTING SETBACK VARIANCES TO
ALETA MATHIESEN FOR ADDITIONS TO A HOUSE AT
4635 BROOK STREET
WHEREAS, Aleta Mathiesen (the "Applicant") is the fee owner of property located at
4635 Brook Street in Medina and legally described as Lot 2, Block 28, Independence Beach,
Hennepin County, Minnesota (the "Property"); and
WHEREAS, the Applicant wishes to construct additional living space and an attached
garage on the single family home on the Property; and
WHEREAS, construction of the additions will require reduction of the front yard setback
from 30 feet to 20 feet (from Brook Street), and reduction of both side yard setbacks from 10 feet to
8.8 feet; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on July
13, 1999 and by the city council at its meeting on July 20, 1999; and
WHEREAS, it has been determined that the construction of the proposed additions on the
Property will not adversely impact the development of adjacent properties for the purpose for which
they are currently zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that the above described setback variances are hereby granted to the Applicant for the
Property, subject to the following terms and conditions:
1. The Applicant must remove the shed on the back (Lake Shore Avenue side) of the
Property within 30 days after the building permit is finalized;

2. The additional living space and attached garage must be constructed in substantial
conformance with the plans and descriptions provided by the Applicant to the city;
3. The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for its costs in reviewing this application; and
4. The Applicant must begin construction of the additions within one year of the date
of the adoption of this resolution or the variances hereby granted shall be null and void.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota, that the variances hereby granted are justified by the hardship to the Property
presented by the small size of the lot. In addition, it is noted that the variances hereby granted are
similar to those enjoyed by other properties in the neighborhood and are consistent with
neighborhood standards.

The motion for the adoption of the foregoing resolution was duly seconded by member Johnson and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, and Smith
and the following voted against same: None Absent: Zietlow
Whereupon said resolution was declared duly passed and adopted.
