HomeMy Public PortalAbout1999-052115 Member Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-52 RESOLUTION DENYING PETITION FOR PREPARATION OF AN ENVIRONMENTAL ASSESSMENT WORKSHEET ON THE ROLLING GREEN BUSINESS PARK PROPOSAL WHEREAS, Rolling Green Business Park L.L.C. (the "Applicant") is the owner of property legally described in Exhibit A attached hereto (the "Property"); and WHEREAS, the Property is currently zoned Rural Residential; and WHEREAS, the Applicant has applied for three approvals relating to the Property: 1. rezoning to the Property to Urban Commercial, 2. subdivision of the Property into lot 1, outlot A and outlot B, with the dedication of an 80-foot road right-of-way for Meander Road, running from east to west, 3. the grant of a conditional use permit for construction of a single -story multi - tenant office/warehouse building on lot 1; and WHEREAS, on August 2, 1999, a petition for preparation of an Environmental Assessment Worksheet ("EAW") was filed pursuant to Minn. Rule 4410.1100 with the Environmental Quality Board ("EQB"); and WHEREAS, on August 3, 1999, the EQB designated the City of Medina as the Responsible Government Unit charged with acting on the petition; and WHEREAS, under Minn. Rule 4410.1100, subp. 6, the City must determine whether the evidence demonstrates that because of the nature or location of the proposed project, the project may have the potential for significant environmental effects; and 99-52 09-07-99 KRC-168223 ME230-299 116 WHEREAS, Phase 1 of the Applicant's proposal, for which the conditional use permit is sought, calls for the construction of a building with an area of 111,504 square feet; and WHEREAS, the Applicant's proposal anticipates the construction of additional commercial buildings on the Property. It is difficult to determine the location and square footage of these buildings at this time, however, because the design, location and size of additional buildings will depend on future market demand and design choices; and WHEREAS, the Applicant has indicated in its conceptual master site plan drawing that future phases of the project may involve the construction of two additional commercial office warehouse buildings with a combined area of approximately 68,500 square feet; and WHEREAS, the total area of buildings to be constructed on the Property will be less than 300,000 square feet; and WHEREAS, the Elm Creek Business Park is not part of a "phased action" under the EQB's rules because there is not common ownership with the project and the Elm Creek Business Park does not meet the tests for a "connected action" under the EQB's rules; and WHEREAS, traffic generated by the project may degrade the level of service on adjoining roads, but traffic impacts are subject to mitigation in the future; and WHEREAS, traffic generated by the project will not have a significant impact on air quality; and WHEREAS, noise generated by the project will not be significant and can be mitigated; and WHEREAS, the construction of Phase 1 will not require filling of wetlands, and will not have significant impacts on water resources, vegetation and wildlife. Future phases can be constructed without requiring the filling of wetlands, and without significant effects on water KRC-168223 ME230-299 99-52 09-07-99 117 resources, vegetation or wildlife. The extension of Meander Road to accommodate future phases of the project will require only minimal filling of wetlands and will not have a significant effect on water resources, vegetation or wildlife; and WHEREAS, taking all the evidence presented into account, the project does not have potential for significant environmental effects. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota, that the petition for preparation of an Environmental Assessment Worksheet is hereby denied.
