Member Smith introduced the following resolution and moved its adoption
CITY OF MEDINA
RESOLUTION NO.99-57
RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 311 BY TITLE AND SUMMARY
WHEREAS, the city council of the City of Medina has adopted Ordinance No. 311, an
interim ordinance establishing and extending a moratorium on development within specified areas
of the community until the City has had an opportunity to consider amendments to its official
controls consistent with its recently adopted comprehensive plan; and
WHEREAS, the interim ordinance is lengthy and contains a map; and
WHEREAS, Minnesota Statutes, § 412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the interim ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina that
the city clerk -treasurer shall cause the following summary of Ordinance No. 311 to be published in
the official newspaper in lieu of the entire ordinance:
Public Notice
The City Council of the City of Medina has adopted Ordinance No. 311. The ordinance is
an interim ordinance which establishes a moratorium on development within the areas of the
community guided as urban commercial, urban commercial-1, uptown Hamel and residential
planned unit development 1 & 2 in the City's new comprehensive plan. This ordinance also
establishes a moratorium on residentially guided property within 1,000 feet of the property guided
urban commercial and urban commercial 1 in the city's new comprehensive plan. The interim
ordinance will allow the City an opportunity to review its official controls, including its zoning
ordinance and subdivision regulations, and make amendments necessary for consistency with the
City's new comprehensive plan. The moratorium will be in effect for one year. The ordinance also
extends the moratorium previously adopted regarding the Elwell property. The full text of
Ordinance No. 311 is available at Medina city hall during regular business hours.

BE IT FURTHER RESOLVED by the city council of the City of Medina that the city
clerk -treasurer keep a copy of the ordinance in his office at city hall for public inspection and that
he post a full copy of the ordinance in a public place within the city.

The motion for the adoption of the foregoing resolution was duly seconded by member Johnson and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
