AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL PLAT OF HIGHWAY 50 EAST WAL-MART SUBDIVISION, A SUBDIVISION OF THE
CITY OF JEFFERSON, MISSOURI.
WHEREAS, Wal-Mart Stores East, L.P., owner of the real estate hereinafter described, having
submitted to the City Council a plat of said real estate, being located in Jefferson
City, Cole County, Missouri, and being part of the Southwest Quarter of the
Southeast Quarter and part of the Southeast Quarter of the Southeast Quarter of
Section 22, Township 44 North, Range 11 West, in the City of Jefferson, Cole
County, Missouri, more particularly described as follows:
Part of the Southeast Quarter of the Southeast Quarter of Section 22, Township 44
North, Range 11 West and part of the Southwest Quarter of the Southeast Quarter
of said Section 22 being all that part of LEPAGE'S SUBDIVISION of record in Plat
Book 6, page 3, Cole County Recorder's Office that lies on the southerly side of the
present U.S. Highway 50/63 right-of-way and its connection to City View Drive; the
southerly line of said right-of-way being defined by the northerly boundary of a tract
of land described by deed of record in Book 548, page 623, and the easterly and
southerly boundaries of another tract of land described by deed of record in Book
555, page 126, Cole County Recorder's Office, all in the City of Jefferson, Cole
County, Missouri, more particularly described as follows: BEGINNING at the
southwest corner of the Southwest Quarter of the Southeast Quarter of the
• aforesaid Section 22, Township 44 North, Range 11 West; thence N2 056'00"E,
along the Quarter Section Line, 424.21 feet to a point on the southerly line of the
U.S. Highway 50/63 and City View Drive connection right-of-way and said point
being the southwesterly corner of the aforesaid tract of land described by deed of
record in Book 555, page 126; thence along said right-of-way line, being defined as
the southerly and easterly boundary of said tract described in Book 555, page 126,
the following courses: S82 044'03"E, 238.85 feet; thence N0 024'46"E, 51.80 feet;
thence N5 029'28"E, 78.55 feet; thence Northerly, on a curve to the right, having a
radius of 410.97 feet, an arc distance of 218.20 feet, (the chord of said curve being
N21°16'53"E, 215.65 feet); thence Northerly, on a curve to the left, having a radius
of 840.00 feet, an arc distance of 250.85 feet, (the chord of said curve being
N38 058'22"E, 249.92 feet); thence S89 007'57"E, 144.78; thence N4 047'24"W,
106.92 feet to the most westerly corner of the aforesaid tract of land described in
Book 548, page 623 and said corner being on the southerly line of the U.S. Highway
50/63 right-of-way; thence leaving the boundary of the aforesaid tract described in
Book 555, page 126, Easterly along said right-of-way line, being defined as the
northerly boundary of said tract described in Book 548, page 623, the following
courses: S83 036'01"E, 86.12 feet; thence S70 059'23"E, 730.33 feet; thence
S44 042'05"E, 2.82 feet to a point intersecting the easterly line of the Southwest
Quarter of the Southeast Quarter of the aforesaid Section 22; thence leaving the
aforesaid right-of-way line and the northerly boundary of said tract described in

WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the
owner of said subdivision, known and referred to as the Plat of Highway 50 East
Wal-Mart Subdivision, that all taxes have been paid, and that in all respects the
requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with
by the owner of said subdivision, and that in all respects the requirements of the
Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats
and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the plat of Highway 50 East Wal-Mart Subdivision, lying, being and
situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat
attached hereto and made a part of this ordinance, is hereby approved and accepted by the City
Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
• SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P08013 — 3000 Maple Leaf Estates Road; Final Subdivision Plat of Highway 50
East Wal-Mart Subdivision. Application filed by Wal-Mart Stores East, L.P., property owner, for
• a Final Subdivision Plat of 32 acres on land zoned C-2 General Commercial. This proposed final
plat includes 2 commercial lots and approximately 2,000 feet of road right-of-way. The property is
located on the south side of Highway 50/63 at the terminus of City View Drive. The property is
described as part of the Southwest Quarter of the Southeast Quarter and part of the Southeast
Quarter of the Southeast Quarter of Section 22, Township 44 North, Range 11 West, Jefferson
City, Cole County, Missouri. (Central Missouri Professional Services, Consultant)
Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Samson explained that the final plat dedicates access to the Wal-Mart
site, city streets, and creates a two(2)acre outlot.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that the Wal-Mart store will
occupy 24.7 acres of the 32 acre tract. A special exception permit approving the new Wal-Mart store
was approved by the City Council on June 19, 2006. One new street to be named Supercenter Drive
is identified on the final plat.
Mr. Wade gave the Engineering Division staff report and explained that infrastructure is being
constructed to serve the subdivision and that plans for public infrastructure were previously approved
with the MoDOT interchange plans. He stated that the final site plan for the Wal-Mart site is being
reviewed at this time for final approval.
No one spoke in opposition to this request and no correspondence was received.
Mr. Bates stated that he concurs with staff comments and recommendations.
p • Mr. Yarnell moved and Mr. Hagan seconded to recommend approval of the Final Subdivision Plat
of Highway 50 East Wal-Mart Subdivision, to the City Council subject to compliance with the technical
corrections and recommendations of the Engineering Division. The motion passed 6-0 with the
following votes:

Subdivision. Application filed by Wal-Mart Stores East, L.P., property owner, for a Final Subdivision Plat of 32
acres on land zoned C-2 General Commercial. This proposed final plat includes 2 commercial lots and
approximately 2,000 feet of road right-of-way. The property is located on the south side of Highway 50/63 at the
terminus of City View Drive. The property is described as part of the Southwest Quarter of the Southeast
Quarter and part of the Southeast Quarter of the Southeast Quarter of Section 22, Township 44 North, Range 11
West, Jefferson City, Cole County, Missouri. (Central Missouri Professional Services, Consultant)
Background
A special exception permit approving the new east side Wal-Mart store was approved by the City Council on June
19, 2006. Street and highway improvement plans have been received and reviewed by City staff and Missouri
Department of Transportation staff. The roadway improvement plans are adequate to meet the requirements for a
subdivision plat and conform with the proposed final subdivision plat.
Description of Proposed Plat
Zoning: C-2 General Commercial
Size of Property: 32 Acres
Number of Lots: 2
Lot Sizes: 24.7 acres and 2.09 acres
treets: One new street is identified on the final subdivision plat. The name of the street is identified as
upercenter Drive. The street extends for a distance of approximately 2,000 feet. The street dead ends at the edge
of the property and a temporary turn around would be constructed at this location. An easement for the temporary
turn around as well as an easement for a bus stop shelter is identified on the plat.
Public Improvement Plans: Street, Stormwater, and Sewer improvement plans have been submitted to the
engineering division.
Staff Recommendation
Staff recommends approval of the final subdivision plat subject to the following conditions:
1. Compliance with the technical corrections and recommendations of the Engineering Division.
