Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-64
RESOLUTION GRANTING SETBACK VARIANCE
FOR THOMAS UNDERWOOD AND LORRI UNDERWOOD
AT 1325 ELSINORE CIRCLE
WHEREAS, Thomas Underwood and Lorri Underwood (the "Applicants") are the fee
owners of the property located at 1325 Elsinore Circle, legally described as Lot 2, Block 3, Medina
Momingside according to the plat on file in Hennepin County, Minnesota (the "Property"); and
WHEREAS, the Applicants wish to construct an addition to their existing house on the
Property; and
WHEREAS, the Property is located at the corner of Momingside Drive and Elsinore
Circle; and
WHEREAS, the required front yard setback from both streets is 30 feet while the
Applicants wish to be able to construct the addition within 25 feet of the front lot line along
Momingside Drive; and
WHEREAS, the city's zoning ordinance requires a variance under these circumstances; and
WHEREAS, this matter was previously reviewed and approved in 1998 but the Applicants
were unable to complete the work prior to expiration of the variance granted on May 19, 1998; and
WHEREAS, this matter was again reviewed by the planning commission at its meeting on
October 12, 1999 at which time the planning commission recommended granting the Applicants a
five-foot front yard setback variance; and
WHEREAS, this matter was reviewed by the city council at its meeting of October 19,
1999.

NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina,
Minnesota that a variance be granted to the Applicants for the Property to allow a reduction in
required front yard setback from 30 feet to 25 feet along Momingside Drive for construction of the
addition as depicted in the plans and drawings submitted by the Applicants to the city, subject to the
requirement that there be only one driveway which must be approved by the City's public works
director.
BE IT FURTHER RESOLVED by the city council that the above variance is consistent
with others which have been granted for corner lots in the Medina Momingside neighborhood and
that the variance hereby granted supercedes that granted on May 19, 1998 pursuant to Resolution
No. 98-24.

The motion for the adoption of the foregoing resolution was duly seconded by member Zietlow
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
