HomeMy Public PortalAbout1999-065149 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-65 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO THOMAS UNDERWOOD AND LORRI UNDERWOOD AT 1325 ELSINORE CIRCLE WHEREAS, Thomas Underwood and Lorri Underwood (the "Applicants") are the fee owners of the property located 1325 Elsinore Circle, which property is legally described as Lot 2, Block 3, Medina Morningside, Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicants have been granted a frontyard setback variance to construct an addition to the existing home on the Property; and WHEREAS, the Applicants have applied for a conditional use permit for a home occupation to be operated from the proposed addition; and WHEREAS, the city's zoning ordinance requires that a conditional use permit be granted by the city council for the proposed home occupation; and WHEREAS, this matter was reviewed by the planning commission at its meeting on October 12, 1999 and by the city council at its meeting on October 19, 1999; and WHEREAS, it has been determined that the conditions of section 825.49.1 regarding home occupations can be complied with by the Applicants on the Property without adversely impacting the development and use of adjacent properties for purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicants to operate a cosmetology salon on the Property, subject to the following terms and conditions: 1. No more than one employee not residing on the Property shall be permitted; RHB-170984 ME230-1-PZ 99-65 11-02-99 150 2. The Applicants must provide off-street parking on a hard surface for a minimum of four vehicles; 3. No signs shall be permitted on the Property other than its address; 4. The cosmetology business shall be conducted only in the 18' x 15' addition authorized by the recent variance; 5. There shall be no outside storage of business related items on the Property; 6. The Applicants acknowledge that this home occupation conditional use permit is not transferable at the time of sale of the Property; 7. The Applicants acknowledge that if the business activity ceases for a period exceeding six months the conditional use permit hereby granted shall be null and void; and 8. The Applicants shall pay to the city an administrative fee in an amount equal to cost to the city of reviewing this application. Dated: November 2, 1999. B.
