HomeMy Public PortalAbout1967 Water & Sewer Easement - Clifford McSarveyE M E IJ T THIS INDENTURE, Made this day of // 1967, by and between / gF the parties of the First Part, hereinafter called the GRANTORS, and the City or McCall, Idaho, a municipal corporation, the - Party of the Second Par`_, hereinafter called the GRANTEE, WITNESSETH: That the GRANTORS for and in consideration of the sum of ONE DOLLAR (S1.00) and other valuable consideration, to them in hand paid by the GRANTEE, the receipt whereof is hereby acknowledged, do by these presents remise, release and forever ON ICLAIM unto the GRANTEE, and to its succes- sors and assigns, a temporary and a permanent easement for a right of way for water and/or sewer pipes, mains and con- duits on, under, through and across the premises hereinafter described, together with the right to construct, maintain, and repair underground pipelines and/or mains for the purpose of conveying ::•a Ler and/or sewage, together further with the right to excava Le and refill ditches and/or trenches for the location cf said water and/or sewer pipes, mains and conduits. The land affected by such easements and rights of is located in Fc_Call, Valley County, Idaho, and is described as follows: A portion of Lots 10, 11 and Townsite of Lardo, according on file and of record in the Valley County, Idaho. 12, Block 5, of the Original to the official platthereof office of the!Recprder of The said easement and right of way covers a,strip of land thirty (30) feet in width during construction and in- • stallation of the utility and a sixteen (16) foot wide strip lying within such 30 foot strip for a permanent easement and right of way, which easements and rights of wa1`fo s h water and/or sewer pipes, mains and conduits, lie equi- distant on e.ch side of the following described center line, to -wit: Beginning at a point on the southerly right of way line of Grove Street, 20.0 feet easterly from the Northwest corner of Block 5 of the Original Townsite of-Lardo; thence south 24°28' East 136.99 feet to the northerly right of way line of River Street. TO HAVE AND TO HOLD, all and singular the said premises, together with the ampurtenances, unto the said GRANTEE and to its successor-: and assigns forever. This or-nt shall be effective as long as said easement shall. be aciurlly user for the purposes above specified, and all right hereunder granted shall revert to the owners of the land whci said use shall have been abandoned_and_.discon- tinued for , corm of five (5) years or longer. The GRANTEE shall at all reasonable times have the right to enter upon the lands hereinabove described for the purpose of constructing, repairing and maintaining said water and/or sewer pipes, mains and conduits, doing as little damage as possible.
