Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-66
RESOLUTION GRANTING AN AMENDED CONDITIONAL
USE PERMIT FOR WOODRIDGE CHURCH
WHEREAS, Woodridge Church (the "Applicant") was granted a conditional use permit by
the city council on August 1, 1995, pursuant to Resolution No. 95-29; and
WHEREAS, the Applicant was granted an amended conditional use permit by the city
council on August 4, 1998, pursuant to Resolution No. 98-41; and
WHEREAS, the Applicant has now requested a second amendment to its conditional use
permit to allow the Montessori School of Wayzata Bay to operate a preschool/kindergarten program
within the school facility beginning in September, 2000; and
WHEREAS, this matter wasreviewed by the planning commission at its meeting on
October 12, 1999 and by the city council at its meeting on October 19, 1999; and
WHEREAS, it has been determined that the Applicant's request for an amended
conditional use permit to allow the operation of the preschool/kindergarten will not impede the
ordinary and normal development of adjacent lands for purposes for which they are zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that an amended conditional use permit be granted to the Applicant for the stated
purpose, subject to the following conditions:
1. The Applicant must remove the old truck and other equipment and debris from the
site;
2. The preschool/kindergarten shall be for children ages 3 through 6;
3. The number of children at the preschooUkindergarten may not exceed 25;
4. The hours of operation of the preschool/kindergarten shall be 8:30 a.m. to 2:45 p.m.,

Monday through Friday;
5. The location of the fenced outside play area shall be at the back of the building as
depicted on the revised site plan which must be submitted by the Applicant to the
city;
6. Drop-off and pick-up of the children must be at the south portion of the north
parking lot;
7. The preschool/kindergarten must be and remain licensed by the Minnesota
Department of Human Services;
8. The area of the building occupied by the preschool/kindergarten must meet all fire
and building codes;
9. The existing septic system must be reviewed by a licensed inspector to insure that it
is sized properly for the additional use imposed by the presence of the
preschool/kindergarten; and
10. The Applicant must pay to the city an administrative fee in the amount necessary to
reimburse the city for the review of this application.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that all terms and conditions of Resolution No.
95-29 and of Resolution No. 98-41 are hereby incorporated by reference and made a part hereof.

The motion for the adoption of the foregoing resolution was duly seconded by member Zietlow
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
