Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-70
RESOLUTION AMENDING CONDITIONAL USE PERMIT
FOR HOLY NAME OF JESUS CATHOLIC CHURCH
WHEREAS, Holy Name of Jesus Catholic Church (the "Applicant") owns and operates a
church, school and related facilities at the intersection of County Road 24 and Brockton Lane (the
"Subject Property"); and
WHEREAS, the Applicant was granted an amended conditional use permit on April 6,
1999 pursuant to Resolution No. 99-20 to facilitate construction of an addition to its facilities; and
WHEREAS, Resolution 99-20 contained provisions regarding minimum landscaping and
screening requirements associated with the new construction; and
WHEREAS, the Applicant has proposed an alternate landscaping and screening plan which
has been reviewed by the city council for its adherence to the objectives of the city in maintaining
the rural character of the community.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. Condition no. 8 of Resolution No. 99-20 shall be amended to read as follows: The
Applicant must screen the easterly parking lot from views from the north. Screening
may be accomplished through a combination of berms and landscaping so long as a
total minimum height of 8 feet is achieved. Trees used for landscaping must be
Black Hill spruce, planted 12 feet on center in two rows. The Applicant must
submit a plan which specifies its landscaping and screening to be installed, which
plan must be reviewed and approved by city staff. The landscaping which the
Applicant has installed along Brockton Road meets the requirements of Resolution
No. 99-20 and must be maintained.
2. The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing this amended conditional use permit.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota, that this resolution amends but does not supersede Resolution No. 99-20 with
regard to the Applicant's use of the Subject Property, except with regard to condition no. 8 thereof.

and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Smith, and Zietlow
and the following voted against same: None Absent: Hamilton
Whereupon said resolution was declared duly passed and adopted.
