SUMMARY STATEMENT: The re -approval of a past zoning map amendment application.
In 2006 Crossbar Condominiums submitted applications for a condominium development (SUB-06-05, PUD-06-01,
DR-06-14, SR-06-20). Those applications were accompanied by rezone application (ZON-06-03) attempting to
change the property from R1 to R16 zoning. On April 3, 2007 the Commission separated the rezone application from
the rest of the project with a motion to approve ZON-06-03. The motion failed and the application moved on to
Council separate from the Crossbar project. On July 12, 2007 the Council approved ZON-06-03 based on the
application's conformance with the Comprehensive Plan's Future Land Use Plan and it being in the best interest of
the citizen's of McCall, but in no way related to the Crossbar project.
Subsequently, a revised version of the Crossbar project was submitted with new applications (SUB-07-12, PUD-07-
08, DR-07-67, SR-07-26). No rezone application accompanied these new applications, because of the assumption that
the aforementioned rezone was in place. These new applications proceeded through the approval process, receiving a
recommendation for approval from the Commission and approval from the Council, with a finding, at both levels,
which assumed that the rezone had been executed. Unfortunately, ZON-06-03 was approved, but the associated
Ordinance and Development Agreement were not published within the legal time limit, making them null and void.
Staff discovered this oversight as they were drafting the Crossbar Development Agreement for Final Plat and Final
Plan submission. This agenda item intends to update the documents (Ordinance and Development Agreement)
associated with the previously approved, but never published, rezone application so as to reflect the current status of
the project. The execution of this rezone, including publishing of the updated ordinance and recordation of the
updated Development Agreement, would bring the actual status of the rezone application up to where it was assumed
to be since 2007.
RECOMMENDED ACTION:
I.Conduct the Public Hearing
2.Approve the presented Development agreement for ZON-06-03
3.Suspend the rules and read by title only one time only Ordinance No
4. Adopt Ordinance No. and authorize mayor to sign all necessary
documents.
