HomeMy Public PortalAbout1999-075173 Member Hamilton introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-75 RESOLUTION REGARDING VACATION OF A PORTION OF MILL STREET WHEREAS, the city of Medina (the "City") has been served with land title registration proceedings from Scott A. House and Alicia A. House, the fee owners of the property at 165 Hamel Road, and Farmers State Bank of Hamel, the fee owner of the property at 145 Hamel Road (collectively, the "Applicants") for the purpose of establishing the boundaries of their respective properties; and WHEREAS, Mill Street, which is owned by the City, lies between and separates the properties and is used by the public for access to certain lands; and WHEREAS, the City is aware that Mill Street as traveled is not in the same location as Mill Street as shown on the plat of the area; and WHEREAS, it is in the interest of the Applicants as well as the City to establish the location of Mill Street as traveled in connection with the land title registration proceedings; and WHEREAS, the Applicants have proposed to grant easements to the City for Mill Street as traveled in exchange for the City vacating the portions of Mill Street which lie within their respective properties; and WHEREAS, consistent with such proposal, the City has scheduled a public hearing on the vacation of a portion of Mill Street as depicted on the map attached hereto as Exhibit A; and WHEREAS, the City has published notice twice in the official newspaper and sent mailed notice at least 10 days prior to the public hearing to affected property owners as required by law; and RHB-173545v 1 ME230-86 99-75 12-21-99 174 WHEREAS, on this date the City has held a public hearing on the proposed vacation of a portion of Mill Street at which hearing all interested parties were heard with respect to said vacation; and WHEREAS, following said public hearing, the City determined that the vacation of the portions of Mill Street depicted in Exhibit A to be in the public interest. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, as follows: 1. The city hereby declares that the portion of Mill Street depicted on Exhibit A is vacated. 2. The city clerk -treasurer is authorized and directed to prepare and present to Hennepin County a notice that the city has completed these vacation proceedings and request that the same be reflected in the county's records. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that the above action is conditioned upon the City receiving easements from the Applicants for Mill Street as traveled and that the clerk -treasurer is directed not to proceed with the completion of this proceeding until he has received said easements from the Applicants.
