Mayor Yu called the City Council Regular Meeting to order at 7:35 p.m. in the Council Chambers located at 5938 Kauffma n Avenue, Temple City . 2. ROLL CALL PRESENT: Coun cilmember-Chavez, Fish, Man, Sternquist, Yu ABSENT: Councilmember-None ALSO PRESENT: City Manager Cook, City Attorney Vail, and City Clerk Kuo 3. INVOCATION Pastor Chris Famisaran from Temple City Seventh-Day Adventist Church, 9664 Broadway, provided the invocation . 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #161 provided a flag ceremony and led those present in the Pledge of Allegiance. 5. CEREMONIAL/PRESENTATIONS-None 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA John Rains, Camellia Festival General Chairman , thanked the City and City Council for their support of the festival and donated a check to the City's Gerald M. Fitzgerald Trust Fund. Steve Stafford, Temple City resident, commented about the homeless in the Temple City Park. Ang ie Dorantes, Temple City resident, invited City Council and the public to attend an upcoming Temple City High School Brighterside performance the weekend of May 19, 2016. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the Special City Council Meeting of May 3, 2016; and 2) Minutes of the Regular City Council Meeting of May 3, 2016. Action: Approved . B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETING OF APRIL 13 , 2016 The City Council is requested to review the Transportation and Publ ic Safety Commission actions of their meeting of April 13, 2016. Action: Received and filed. C. APPROVAL OF FIRST AMENDMENT TO THE AGREEMENT FOR USE OF FACILITIES WITH TEMPLE CITY UNIFIED SCHOOL DISTRICT The current Agreement for Use of Facilities with the Temple City Unified School District expires June 30 , 2016. To accommodate the City's summer recreation programs, the City Council is requested to approve the First Amendment for Use of Facil ities with Temple City Unified School District, extending the current agreement through August 19, 2016 . Action : Approved the First Amendment to the Agreement for Use of Facilities with Temple City Unified School District for general facility use. D. ADOPTION OF RESOLUTION NO . 16-5163, DECLARING THE CITY'S INTENTION TO LEVY AND COLLECT LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR 2016-1 7 AND City Council Minutes May 17, 2016 Page 3 of 9 ESTABLISHING THE TIME AND PLACE FOR HEARING PUBLIC OBJECTIONS Approval of the Engineer's Report for the Temple City Citywide Lighting and Maintenance District for Fiscal Year (FY) 2016-17 will allow the City to continue the process to set the assessment rates for the FY 2016-17 Lighting and Maintenance District. Action : E. VISA CARD REPORT Accepted the Engineer's Report for Temple City Citywide Lighting and Maintenance District for Fiscal Year (FY) 2016-17; and adopted Resolution No. 16-5163 declaring its intention to levy and collect assessments for (FY) 2016-17 within the Citywide Lighting and Maintenance District. The City Council is requested to review, receive and file the Visa Card Report. Action: Received and filed report. F. ADOPTION OF RESOLUTION NO. 16-5167 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 16-5167 authorizing the payment of bills. Action: Adopted Resolution No. 16-5167. 8. PUBLIC HEARING A. APPROVAL OF RESOLUTION NO. 16-5166 VACATING A PORTION OF MYDAAVENUE The southern end of Myda Avenue has a rectangular right-of-way that does not align with the curb, gutter and sidewalk of the cu l-de-sac. The proposed action would vacate a portion of the Myda Avenue right-of-way, such that the right-of-way boundary would be consistent with the wall and street improvements. Community Development Director Forbes gave a brief summary of the staff report. City Council Minutes May 17, 2016 Page 4 of 9 Mayor Yu opened public comment. Hearing no request to speak, Mayor Yu closed public comment. Councilmember Chavez made a motion to adopt Resolution No. 16-5166 vacating a portion of the public right-of-way at the southern end of Myda Avenue , and provided direction that the vacation be reflected on Final Parcel Map No. 72220. Seconded by Mayor Pro Tem Sternquist and approved by the following votes: AYES : RECUSED: NOES: ABSENT: Councilmember: Chavez, Fish, Man, Sternquist, Yu Councilmember: None Councilmember: None Councilmember: None B. INTRODUCTION AND FIRST READING OF ORDINANCE N0.16-1014 AMENDING TITLE 9, CHAPTER 1 AND 2 OF THE TEMPLE CITY MUNICIPAL CODE (SERIES 1 CODE AMENDMENTS) City Council is requested to adopt Ordinance No. 16-1014, amending the Temple City Zoning and Subdivision regulations. The proposed amendments would identify necessary improvements and clarifications. Planning Manager Reimers gave a summary of the staff report. City Council commented and discussed regard ing the proposed code amendments. Mayor Yu opened public comments. Steve Stafford, Temple City resident, made a comment about washers and dryers installed outside of a dwelling. Hearing no further request to speak, Mayor Yu closed public comments. Councilmember Man made a motion to introduce for first read ing by title only and waive further reading of Ord inance No. 16-1014, amending Title 9, Chapter 1 and 2 of the Temple City Municipal Code, with the amendment to exempt balconies from being counted as floor-area-ratio if they are located in front of the house; and scheduled the second read ing of Ord inance No. 16- 1014 for June 7, 2016. UNFINISHED BUSINESS A. AWARD OF CONTRACT TO PRI NCIPLES CONTRACTING, INC. FOR THE LI VE OAK PARK WALKING PATH PROJECT (C IP NO. P16-01 ) The City Council is requested to accept the bid from Principles Contracting, Inc. and award the related Public Works Contract to allow the Live Oa k Park Walking Path Project to move into construction . Parks and Recreation Director Burroughs gave a summary of the staff report. City Council commented and discussed regarding the project. Mayor Yu opened public comments. Hearing no request to speak, Mayor Yu closed public comments. Councilmember Chavez made a motion and found the Live Oak Park Walking Path Project exempt from environmental review under the California Environmental Quality Act pursuant to Section 15301 of the State California Environmental Quality Act Guidelines pertaining to minor alterations to existing facilities; awarded a Public Works contract to Principles Contracting , Inc. for the Base Bid as well as Additive Alternates 1 and 2 for the Project for a total contract price of $282,500; authorized the City Manager to execute the contract; and approved a budget amendment, in the amount of $20,500, for the purchase and installation of five drinking fountains for the Project. FI SCAL YEAR 2015-16 CITY BUDGET -THIRD QUARTER BUDGET AMENDMENTS City Council is requested to approve the third quarter budget amendments to ensure actual spending levels in individual line items are within budgeted appropriations as of March 31, 2016. City Council Minutes May 17, 2016 Page 6 of 9 Administrative Services Director Hause gave a brief summary of the staff report and highlighted the proposed adjustments. City Council commented and discussed regarding the third quarter budget amendments. Mayor Yu opened public comments. Hearing no request to speak, Mayor Yu closed public comments. Councilmember Man made a motion to authorize staff to revise various budgeted appropri ations for the Fiscal Year (FY) City Budget as indicated in the attachment to ensure revenue estimates are accurate and actual spending levels are within budgeted appropriations during the current fiscal year. UPDATE FROM CITY MANAGER Thanked Upper San Gabriel Valley Water District for installing water tolerant landscape in front of City Hall and commented on the upcoming City Council Budget Study Session. 13. SPECIAL ELECTION AD HOC COMMITTEE (Mayor Yu and Councilmember Chavez)-Formed 12/1 5/1 5 Councilmember Chavez reported on the ad hoc committee meeting on May 17 and shared briefly regarding the survey that was conducted . The ad hoc committee gave directions to staff. L. CITY COMMISSIONER RECRUITMENT AD HOC COMMITTEE (Mayor ProTem Sternquist and Councilmember Man)-Form 4/19/2016 Councilmember Man reported that the ad hoc committee will conduct the initial interview of applicants on Friday, May 20, 2016. M. CITY BUDGET AD HOC COMMITTEE (Mayor Yu and Councilmember Man)-Form 4/19/2016 Councilmember Man commented on the ad hoc committee meetings in May and on the upcoming City projects. Mayor Yu disbanded the Civic Center Master Plan Stand ing Committee. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER CHAVEZ -None B. COUNCILMEMBER FISH Would like to have another City Hall open house and commented on City's Facebook postings. C. MAYOR PRO TEM STERNQUIST Commented on a session from the California Contract Cities Conference regarding human trafficking. F.
