HomeMy Public PortalAbout1999-076175 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-76 RESOLUTION VACATING PORTIONS OF SPRUCE STREET AND CEDAR STREET WHEREAS, the city of Medina (the "City") has received a request from John R. Beasley and Darsie L. Beasley (the "Applicants") who are the fee owners of the property at 2998 Lakeshore Avenue to vacate portions of unopened Spruce Street and Cedar Street adjacent to the Applicants' property; and WHEREAS, the portions of unopened Spruce Street and Cedar Street proposed to be vacated are depicted on the map attached hereto as Exhibit A; and WHEREAS, pursuant to Minn. Stat. § 412,851, the City scheduled a public hearing to consider the vacation request; and WHEREAS, the notice of said public hearing was published twice in the official newspaper and was mailed to the owner of the affected property at least 10 days before the hearing in accordance with law; and WHEREAS, the City has held the public hearing on the street vacation at which hearing all interested parties were heard with respect to said vacation; and WHEREAS, following said public hearing, the City determined the vacation of the described portions of unopened Spruce Street and Cedar Street to be in the public interest. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota as follows: 1. The City hereby declares that the portions of unopen Spruce Street and Cedar Street described on Exhibit A attached hereto are vacated. RHB-173526v1 ME230-1-PZ 99-76 12-21-99 176 2. The city clerk -treasurer is authorized and directed to prepare and present to Hennepin county a notice that the City has completed these vacation proceedings and request that the same be reflected in the county's records. Ferris, Mayor Paul Robinson, Clerk -Treasurer The motion for the adoption of the foregoing resolution was duly seconded by member Zietlow and upon vote being taken thereon, the following voted in favor thereof: Ferris, Hamilton, Johnson, Smith, and Zietlow and the following voted against same: None Whereupon said resolution was declared duly passed and adopted.
