Mayor Yu called the City Council Reg ular Meeting to order at 7:35p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember-Chavez, Fish, Man, Sternquist, Yu ABSENT: Councilmember-None ALSO PRESENT: City Manager Cook, City Attorney Vail, and City Clerk Kuo 3. INVOCATION Pastor Walden from First Baptist Church , 6019 Baldwin Avenue, provided the invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #17 4 provided a flag ceremony and led those present in the Pledge of Allegiance. 5. CEREMONIAL/PRESENTATIONS A. PET OF THE MONTH Diane Rios, San Gabriel Humane Society volunteers, introduced the featured pet for the month "Peter". Those interested in adopting him can call the San Gabriel Valley Humane Society at (626) 286-11 59. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA-None 7. Action: Approved. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETING OF MAY 11 , 2016 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of May 11 , 2016. Action: Received and filed . C. PARKS AND RECREATION COMMISSION ACTIONS-MEETING OF MAY 18,2016 The City Council is requested to review the Parks and Recreation Commission Actions of their meeting of May 18, 2016. Action : Received and filed . D. LETTER OF OPPOSITION: PROPOSED "BY-RIGHT" HOUSING LEGISLATION Governor Brown's proposal would compel local governments to approve urban housing developments without detailed reviews. Action : Authorized Mayor to sign letter expressing opposition . E. SECOND READING AND ADOPTION OF ORDINANCE NO. 16-1014 AMENDING TITLE 9, CHAPTER 1 AND 2 OF THE TEMPLE CITY MUNICIPAL CODE (SERIES 1 CODE AMENDMENTS) The proposed amendments identify and correct necessary improvements and provide clarification in the City's Zoni ng and Subdivision regulations. City Cou ncil Minutes June 7, 2016 Page 3 of 13 Action : Adopted and waived further reading of Ordinance No. 16-1014 amending Title 9, Chapter 1 and 2 of the Temple City Municipal Code. F. APPROVAL OF A SERVICE AGREEMENT WITH RED 88 MEDIA FOR CITY VIDEO PRODUCTION, RECORDING, EDITING AND SUPPORT SERVICES The City Council is requested to approve a Service Agreement with Red 88 Med ia to provide video record ing of City Council meetings for live and delayed broadcast to the community. Action: Approved a Service Ag reement with Red 88 Media for City's video production, recording , editing and support services; and authorized the City Manager to sign and execute the agreement. G. APPROVAL OF AGREEMENT FOR USE OF FACILITIES WITH THE EL MONTE CITY SCHOOL DISTRICT The current Agreement for Use of Facilities with the El Monte City School District expires June 30 , 2016. The new 2-year agreement will allow both parties to continue to use facilities for public use through June 30 , 2018. Action : Approved a two-year Agreement for Use of Facilities with the El Monte City School District. H. APPROVAL OF LICENSE AGREEMENTS WITH TEMPLE CITY IMMANUEL CHURCH AND FIRST LUTHERAN CHURCH OF TEMPLE CITY Approval of the License Agreements with Temple City Immanuel Church and First Lutheran Church of Temple City will allow the City to use facilities at those locations for summer recreation programs. Action: Approved the License Agreement with Temple City Immanuel Church and First Lutheran Church of Temple City; authorized the City Manager to execute the Agreement; and approved a budget amendment in the amount of $9 ,000 . I. APPROVAL OF FIRST AMENDMENT TO THE AGREEMENT FOR TREE MAINTENANCE SERVICES WITH WEST COAST ARBORISTS City Council Minutes June 7, 2016 Page 4 of 13 The City Council is requested to approve an amendment to the Agreement for Tree Maintenance Services with West Coast Arborist amending the term of contract for one additional year and the compensation to reflect a 2% COLA. Action : Approved the First Amendment to the Agreement for Tree Maintenance Services with West Coast Arborists and authorized the City Manager to execute the Amendment. J. THIRD QUARTER TREASURER'S REPORT, REVENUE AND EXPENDITURE SUMMARY REPORTS AND CAPITAL IMPROVEMENT FINANCIAL REPORT To keep the City Council updated on the status of the City's financial activities, the Financial Status Reports are provided to the City Council on a quarterly basis. Action : Received and filed the Third Quarter City Treasurer's Report, Revenue and Expenditure Summary Reports and the Capital Improvement Financial Report. K. APPROVAL OF A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF TEMPLE CITY AND THE TEMPLE CITY EMPLOYEES ASSOCIATION FROM JULY 1, 2016 THROUGH JUNE 30, 2018 The City and Temple City Employees Association have come to an agreement on wages and benefits for the period of July 1, 2016 through June 30, 2018. Action : Adopted Resolution No. 16-5169 approving the Memorandum of Understanding between the City of Temple City and the Temple City Employees Association and amending sa lary ranges for positions represented by Temple City Employees Association in accordance with the negotiated terms in the Memorandum of Understanding. L. ADOPTION OF RESOLUTION NO. 16-5168 ELIMINATING EMPLOYER PAID MEMBER CONTRIBUTIONS FOR "CLASSIC" TEMPLE CITY EMPLOYEE ASSOCIATION UNIT MEMBERS City Council Minutes June 7, 2016 Page 5 of 13 In order to implement the Memorandum of Understanding with the Temple City Employees Association, a Resolution suspending all Employee Paid Member Contributions must be adopted . Action: Adopted Resolution No. 16-5168 eliminating the remaining one percent Employer Paid Member Contributions currently paid to the California Public Employees Retirement System for employees represented by Temple City Employees Association effective with the pay period Ju ly 8, 2016. M. APPROVAL OF RESOLUTION NO. 16-5172 ADOPTING SALARY AND BENEFIT CHANGES FOR UNREPRESENTED FULL TIME MANAGEMENT EMPLOYEES FOR JULY 1, 2016 THROUGH JUNE 30 , 2017 The Resolution authorizes certain salary and benefit adjustments for all unrepresented full time management employees. Action: Adopted Resolution No. 16-5172 adopting salary and benefit changes for unrepresented full time management employees for July 1, 2016 through June 30, 2017. N. ADOPTION OF RESOLUTION NO. 16-5174 ADOPTING REVISED SALARY RANGES FOR UNREPRESENTED PART-TIME CLASSIFICATIONS FOR FISCAL YEAR 2016-17 The Resolution authorizes salary adjustments for all employees in unrepresented part-time classification. Action: Adopted Resolution No. 16-517 4 adopting salary ranges for unrepresented part-time classifications for Fiscal Year 2016-17. 0 . CREATION OF NEW CLASSIFICATION TITLES AND APPROVAL OF THE RESPECTIVE SALARY RANGES IN ANTICIPATION OF INTENDED FUTURE RE-CLASSIFICATION OF VARIOUS EXISTING POSITIONS Amendment of the Classification Plan for the following positions: Building and Code Inspector I, II , Ill; and Parks and Recreation Manager. City Council Minutes June 7, 2016 Page 6 of 13 Action: Adopted Resolution No. 16-5173 amending the Employee Classification Plan and approving the respective salary ranges. P. ADOPTION OF RESOLUTION NO. 16-5175 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 16-5175 authorizing the payment of bills. Action: Adopted Resolution No. 16-5175. 8. PUBLIC HEARING A. MODIFICATION OF AN APPROVED CONDITIONAL USE PERMIT TO ALLOW EXTERIOR IMPROVEMENTS FOR A NEW RESTAURANT LOCATED AT 9055 LAS TUNAS DRIVE, #1 05 The requested improvements include using a different material and installing an additional sign that is not permitted by the shopping center's master sign program and prohibited by the City's Zoning Code. Planning Manager Reimers gave an overview of the staff report. Councilmember Chavez left the meeting at 7:50 p.m. and returned at 7:52 p.m. City Council asked questions and discussed regarding modification to the exterior of Bistro Na, a new restaurant located at 9055 Las Tunas Drive, #1 05. Mayor Yu opened public hearing. Stanley Tai, Architect representing the Applicant, spoke regarding the proposed design and stated that the modification is visible only from the courtyard. He stated that the proposed change will not be a distraction to the overall look of the shopping center. Steve Stafford, Temple City resident, spoke against allowing modification to an approved Conditional Use Permit regarding an exterior improvement for a new restaurant. He expressed the importance of consistency in signage within the City. Peter Choi, Temple City Chamber of Commerce President, spoke in favor of the City Council allowing exterior improvements to the new restaurant. He City Council Minutes June 7, 2016 Page 7 of 13 stated that the design will add architectural interest and beautify the entrance of the restaurant. City Council asked questions and discussed regarding the add itional sign and the proposed modification to the exterior design of the restaurant. City Attorney stated that it is well within City Council's discretion to determine whether the proposed modification is consistent with the approved Conditional Use Permit and the City's Municipal Code. Hearing no further request to speak, Mayor Yu closed public hearing. Mayor Yu asked for Council comments. Councilmember Fish stated that she would not want to do anything that would hinder new businesses from opening in the city. However, she is in favor of having the property look consistent. She would li ke to see the property and business owner follow the originally approved arch itectural design for the property. She does not have a problem with a sign over the door since it can't be seen from the street. Councilmember Man stated that he would be interested to know if plazas attract more customers if properties were allowed to have architectu ral design variance versus those properties with consistent look. He wants to go with the direction that would best help the business. He is in favor of approving the applicant's request. Councilmember Chavez commented that this project started 8 years ago and what was approved then may not work now. He is not opposed to the proposed exterior modification as submitted by the applicant. However, he would also like to see consistency in the look of the property but allow leniency in the architectural design so businesses can attract customers. He would like to see a third option besides what staff and applicant has proposed , which is a redesign with consistency so that everybody is on the same page. Mayor Pro Tem Sternquist stated that neither the City nor the property owner anticipated that the tenants would make changes to the exterior of their businesses. She does not feel the proposed embellishment would take away from the original design of the property. She feels the proposed design would enhance the look of the square. She does not think this one enhancement will cause other business or the center to not be successful. Mayor Yu felt there were two issues for City Council to address. First is City Council Minutes June 7, 2016 Page 8 of 13 whether or not the sign is in compliance with City's sign ordinance or sign program. Second is if the proposed architectural embellishment is in substantial compliance with the Conditional Use Permit that was approved with the property. He considers the additional sign above the business as architectural element. He feels the proposed design is timid and finds the proposal to be in compliance with the shopping center design. He commented that the City should not expect a Conditional Use Permit for a new mall to have no changes . He is in favor of allowing businesses to have their own branding. Councilmember Chavez made a motion to reverse Planning Commission's decision and grant the request submitted by the applicant. Councilmember Man made a comment regarding the motion. Councilmember Chavez amended his motion to find that the proposed changes as submitted by the applicant are in substantial compliance with the CUP and grant the applicant's request to make the exterior improvements. City Attorney Vail made a comment regarding the motion . Also any future changes to the design element of the Temple City Square shall be brought back to City Council for consideration. UNFINISHED BUSINESS A. APPROVAL OF AGREEMENT WITH THE SAN GABRIEL VALLEY HUMANE SOCIETY FOR ANIMAL CONTROL, SHELTER, AND LICENSING SERVICES Approval of an agreement with the San Gabriel Valley Humane Society will ensure that the City will be able to continue providing animal control, shelter, and license services for the community. City Manager Cook provided a summary of the staff report. City Council Minutes June 7, 2016 Page 9 of 13 Cindy Rigney, President of San Gabriel Valley Humane Society Board, answered City Council questions regarding the cities they service and services they provide. Mayor Yu opened public comment. Hearing no request to speak, Mayor Yu closed public comment. Councilmember Chavez made comments and asked questions regarding this year and future Rabies Clinic. Steve Terry, former president of sister cities, answered questions regarding the Sister Cities' involvement and revenue they make from the annual Rabies Clinic Community Development Director Forbes answered City Council's questions regarding the proposed agreement with San Gabriel Valley Humane Society. Councilmember Man asked questions regarding the shelter's services and the revenue that would be returned to the City after the services are transferred to the shelter. He also commented on the shelter being the custodian of the licensing records and that they would need to be able to produce requested records. Councilmember Chavez made a motion to approve an agreement between the City of Temple City and the San Gabriel Valley Humane Society for animal control, shelter, and licensing services; and authorized the City Manager to execute the agreement. The standing committee received an update regarding the school bond projects and the Longden Elementary School traffic calming, promotion of the little free libraries, how to support the schools regarding their upcoming events and purpose of the standing committee. CITY COMMISSIONER RECRUITMENT AD HOC COMMITTEE (Mayor Pro Tern Sternquist and Councilmember Man)-Form 4/19/2016 Councilmember Man reported that the Ad Hoc Committee recently reviewed all the applications and conducted initial interviews with selected applicants. He shared that the City received two applications for the three seats expiring on the Public Arts Commission. However, the City has received add itional applications for this Commission after the application deadline. The City did not receive enough applications to evaluate to fill the available seats. The Ad Hoc Committee recommended , for City Council's consideration, to extend the recruitment for the Public Arts Commission and allow the Ad Hoc to evaluate the additional applications that were submitted. In regards to the other commissions, the ad hoc provided a recommended list of names of applicants for interview in front of full Council. Additionally, the Ad Hoc Committee recommended that City Council discuss the role of the Public Arts Commission in light of the applications received. Councilmember Chavez suggests that City Council have th is discussion regarding the Public Arts Commission before reviewing the additional applications submitted. Mayor Pro Tern Sternquist directed City Clerk to contact applicants for final interview with full City Council. L. CITY BUDGET AD HOC COMMITTEE (Mayor Yu and Councilmember Man)-Form 4/19/2016 City Council Minutes June 7, 2016 Page 12 of 13 No report. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER CHAVEZ Shared that he attended a Pasadena City College meeting regarding their Centennial Facilities Master Plan update. He commented that the initial cost for the 20 year plan could cost up to 1 bill ion and 60 million dollars. B. COUNCILMEMBER FISH Made a comment about the City Clerk's Master Municipal Certification. Spoke regarding the high school's grad night event this Friday. C. COUNCILMEMBER MAN Announced that the Older American Luncheon is this Saturday honoring Temple City's Older American of the Year, Grace Campos. D. MAYOR PROTEM STERNQUIST Invited everyone to the San Gabriel Valley Open Street Event this Sunday, 10 a.m. to 1 p.m . in El Monte, hosted by Metro. E. MAYOR YU Recognized Sheriff Reserve Ed Chen for volunteering his time and for his service. 16.
