Hause, Administrative Services Director SUBJECT: ADOPTION OF RESOLUTION NO. 16-5171 APPROVING THE MASTER FEE AND FINE SCHEDULE FOR FISCAL YEAR 2016-17 AND. ESTABLISHING NEW FEES FOR PARKS AND RECREATION PROGRAMS RECOMMENDATION: The City Council is requested to: 1. Conduct a Public Hearing; and 2. Adopt Resolution No. 16-5 171 (Attachment "A") approving the Master Fee and Fine Schedule for Fiscal Year (FY) 2016-17 and establishing new fees for several parks and recreation programs. BACKGROUND: 1. From 1960 to 2003, the City Council adopted various resolutions over the years establishing and amending fees to recover the cost to the City for providing various services and programs. 2. On June 3, 2003, the City Council adopted Resolution No. 03-4185 amending existing fees and establishing new fees relating to business licenses and business permits. 3. On September 6, 2005, the City Council adopted Resolution No. 05-4374 amending the sewer reconstruction development fee for multifamily residential projects. On February 16, 2010, the City Council authorized the City Manager to enter into an agreement with Revenue and Cost Specialists to prepare a Cost Allocation Plan and Comprehensive User Fee Study. 5. On June 28 , 2011 , the City Council adopted Resolution No . 11 -4757 establishing the Temple City Master Fee Schedule to modify existing fees and establish new fees to defray the costs of providing certain services based on the findings of the Cost Allocation Plan and Comprehensive User Fee Study. The City Council was advised that the second phase of implementing the Study, primarily additional park and recreation program fees, would be completed within six to eight months. 6. On May 1, 2012, the City Council adopted Resolution No. 12-4814 amending the Master Fee Schedule to establish fees and charges to defray costs for various parks and recreation programs. 7. On October 16, 2012, the City Council adopted Resolution No. 12-4863 amending the Master Fee Schedule to modify existing fees and establish new fees for public works and engineering services. 8. On April 2, 2013, the City Council adopted Resolution No. 13-4897 amending the administrative fine schedule for violations of the Temple City Municipal Code. 9. On July 7, 2015, the City Council adopted Resolution No. 15-5102 amending fees and establishing new fees for parks and recreation programs and facilities. 10. On August 18, 2015, the City Council adopted Resolution No. 15-5113 amending fees for planning, building , and public works services. 11 . On June 9, 2016, the notice for Public Hearing was published in the Temple City Tribune. ANALYSIS: Temple City's fees and fines were previously contained in multiple resolutions adopted over the past 13 years. The Master Fee and Fine Schedule combined all fees and fines into a single schedule. The schedule supersedes all previous fee schedules and resolutions such that the most current fees and fines are located in the same place. The intent is that the schedule will be updated as needed and adopted in conjunction with the City Budget each year. Any new fees or fines established in the future would be added to the Master Fee and Fine Schedule rather than being adopted separately. The proposed Master Fee and Fine Schedule does not change any of the fees or fines adopted in prior years, including the fees adopted in 2015 pertaining to parks and City Council June 21 , 2016 Page 3 of 3 recreation, planning , building, and public works. The schedule simply combines all of the previously adopted fees into a single document. A few non-substantive changes have been incorporated regarding business license fees to clarify ambiguities from the prior fee schedule. The proposed Master Fee and Fine Schedule includes several new fees for parks and recreation programs, as follows: • Adult basketball: $350; • Adult volleyball: $200; • Junior high flag football : $30; • Youth soccer: $30; • Little STARS: $90; • Fall Festival car show entry: $20; and • Fall Festival craft booth: $20. The proposed fees would help to defray the costs of operating the corresponding programs. No increases are proposed to any existing fees. CITY STRATEGIC GOALS: Approval of the Master Fee and Fine Schedule furthers the City Strategic Goals of Good Governance and Sustainable Infrastructure by allowing the City to continue defraying costs for providing various programs and services, and use of City facilities. FISCAL IMPACT: Approving the Master Fee and Fine Schedule would facilitate achieving the revenue projections in the FY 2016-17 City Budget, wh ich are based off of the fees and fines specified in the schedule. Consistent with previous City Council direction, the fees generally aim to achieve cost recovery for the corresponding programs and services, with the exception of the planning fees, which achieve 75 percent cost recovery, and the parks and recreation fees, which are determined based on a combination of cost recovery, program demand, and comparison to neighboring cities. Resolution No. 16-5171 with Master Fee and Fine Schedule ATTACHMENT A RESOLUTION NO. 16-5171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE MASTER FEE AND FINE SCHEDULE FOR FISCAL YEAR 2016-17 AND ESTABLISHING NEW FEES FOR PARKS AND RECREATION PROGRAMS WHEREAS, the City Council of the City of Temple City desires to defray the costs of providing various programs, services, and facilities; and WHEREAS, the City Council has received and considered information about the actual cost of providing such programs, services, and facilities ; and WHEREAS, the City Council held a duly noticed public hearing on June 21, 2016, to consider approving the Master Fee and Fine Schedule that incorporates all previously adopted fees and fines and establishes several new fees for parks and recreation services. NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve, find , determine, and order as follows : SECTION 1. The fees set forth in the Master Fee and Fine Schedule, attached hereto as Attachment "A" and incorporated herein by reference, are reasonably necessary to recover the costs of providing the programs, services, and facilities for which such fees are levied or authorized to be levied. SECTION 2. The following City Council Resolutions and any attachments thereto are hereby superseded in their entirety by this resolution and the Master Fee and Fine Schedule, attached hereto as Attachment "A" and incorporated herein by reference: • Resolution No. 94-3344, adopted June 21 , 1994; • Resolution No. 96-3550, adopted November 19, 1996; • Resolution No. 97-3584, adopted April15, 1997; • Resolution No. 03-4185, adopted June 3, 2003; • Resolution No. 05-4374, adopted September 6, 2005; • Resolution No. 06-4444, adopted September 19, 2006; • Resolution No. 10-4679, adopted June 29 , 201 0; • Resolution No. 11-4757, adopted June 28 , 2011 ; • Resolution No. 12-4814, adopted May 1, 2012; • Resolution No. 12-4863, adopted October 16, 20 12; • Resolution No. 13-4897, adopted April 2, 2013; • Resolution No. 15-5102, adopted July 7, 2015; and • Resolution No. 15-5113, adopted August 18, 2015. SECTION 3. The City Clerk shall certify to the passage and adoption of this Resolution and it shall thereupon take effect. The initial license fee and permit fee payment is prorated quarterly for all lice nse and permit types. Proration is ca lcu lated as a percentage of the fee based on when the business is initially licensed as follows: January 1-March 31 : 100%, April1-June 30: 75%, July 1 -September 30: SO%, October 1-December 31: 25% • Process fees listed below are one-time fees that are due payable when a business application is submitted. Process fees are required for new businesses and for any change to an existing business that requires a new application to be submitted, including but not limited to moving to a different location or a change of ownership. • Other fees listed below are annual fees that are due payable when a business application is submitted and annually thereafter, unless otherwise noted. An additional fee equal to SO perce nt of the application fee shall be due payable at the time of a third resubmittal.
