SUMMARY STATEMENT:
As a result of many attempts to create a ground lease that is fair and equitable Council had directed the City Attorney
to develop a lease that incorporates Rural Developments recommendations. Attached is a memo outlining the history
of the Ground Leases with Neighborhood Housing Services for the McCall Avenue Homes.
In the interest of equity and simplicity of administration, the Ground Leases not held by NHS should also be amended
and restated. If approved by the Council, staff will contact the other home owners to amend their leases. Additionally,
the covenants should be removed from all lots subject to the amended Ground Lease. If approved by the Council, staff
will take the necessary steps to remove the covenants from the appropriate lots.
Also attached are the Amended and Restated Ground Lease, a marked lease with revisions, a clean version with
changes, and the USDA Rural Development Lease Rider.
RECOMMENDED ACTION:
1. Approve the Amended and Restated Ground Lease V3 with Neighborhood Housing Services for the
Remaining McCall Avenue Homes and authorize the Mayor to sign all necessary documents.
2. Direct Staff to contact all the other lease holders with an offer to sign the new lease.
3. Direct the City Attorney to draw up a document that dissolves the covenants.
