SUMMARY STATEMENT:
The applicant submitted a Conditional Use Permit application for the remodel
unoccupied, Pitcher Bar structure, including a drive-thru window located at 501 N. 3rd
the Shell gas station. The drive-thru window will be located on the north side of the structure

RECOMMENDED ACTION:
1. Approve CUP-10-03 subject to the presented Findings and Conclusions.
2. Approve the Development Agreement for CUP-10-03 and authorize the mayor to sign all
necessary documents.
3. Revoke CUP 09-06, which authorized a Drive-Thru at 507N. Third Street Old Town Station.
