SUMMARY STATEMENT:
Property owner Timothy Mills is appealing the Building Department denial for a refund request of building
permit #05-3128. The original building permit was issued on October 4, 2005 at the location of 130 Gena
Way for an addition to the existing house. An extension for the building permit was granted by the Building
Official for an additional 180 days from April 4, 2006.
A building permit expires after 180 days unless the permit is extended (see Building Permit Expiration,
Refund, and Transfer Policy for further information.)
Timothy Mills submitted a Request for Refund form on March 2, 2010. The owner stated that the original
request for refund was made orally within 180 days and prior to the building permit extension. No dated
request or denial document can be produced by either the owner or the City. The current Building Official
responded to the owner stating that he does not have the authority to refund a permit based on verbal
information presented 5 years ago. Therefore, the owner has appealed to the judgment to the McCall City
Council according to the procedure outlined in MCC 2.3.050.
RECOMMENDED ACTION:
Uphold the decision of the Building Official to deny a refund for Building Permit #05-3128.
