HomeMy Public PortalAboutM 1991-03-19 - CC2~ REGULAR MEETING MARCH 19, 1991 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road on the above date at 7:30 p.m. Mayor Henning in the chair. Councilmembers Heine, Rea, Richards, Wells, Henning answered the roll call. Also present were City Manager Gomez, City Attorney Barbosa, and City Clerk Hooper. City Clerk announced the agenda had been duly posted in accordance with The Brown Act. It was moved by Councilmember Rea, seconded by Councilmember Heine and carried, to approve the minutes of March 5, 1991. It was moved by Councilmember Wells, seconded by Councilmember Rea to approve the following proclamations: a. Rail Safety Week b. Medical Laboratory Week ROLL CALL• AYES: COUNCILMEMBERS HEINE, REA, RICHARDS, WELLS, HENNING NOES: NONE ABSENT: NONE Commendation was presented to Lena Sparks, Librarian in Charge of the Lynwood Library, congratulating her on her upcoming retirement. Each Councilmember made remarks thanking Mrs. Sparks for her dedicated services and extended best wishes on her retirement. It was moved by Councilmember Rea, seconded by Councilmember Heine to recess to Lynwood Redevelopment Agency and Lynwood Information, Inc., at 7:41 p.m. Council was reconvened at 7:50 p.m. PUBLIC ORAL COMMUNICATIONS: AGENDA ITEMS ONLY: Hearing no response, public oral communications was closed. SCHEDULED MATTERS: Mayor Henning announced the -time had arrived to conduct a public Condemnation hearing on item 10-Necessity to acquire properties by Condemnation Procedure Procedures-Long Beach Boulevard Improvement Projects-Phase IIB Agnes Street to Palm Avenue. Public Works Director Murga stated there were forty property owners who had agreed to sell, out of a total of forty-seven. It was moved by Councilmember Rea, seconded by Councilmember Heine to open public hearing. NOES: NONE ABSENT: NONE RES 91-36 RESOLUTION NO. 91-36 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRES THE ACQUISITION OF CERTAIN REAL PROPERTY IN FEE FOR PUBLIC PURPOSES AND ALL USES APPURTENANT ~ ALONG LONG BEACH BOULEVARD BETWEEN AGNES STREET AND PALM AVENUE." was presented. Mayor Henning announced the time had arrived to conduct a public ZCA hearing on item 11-Zoning ordinance amendment no. ZOA 10-Planned Residential Development Zone, Citywide. It was moved by Councilmember Wells, seconded by Councilmember Richards to open the public hearing. CM Rea on Councilmember Rea moved to pull item from agenda as consideration water ration must be given to the current water shortage and the effects of residential development. Stated he is in favor of .the amendment as Home devel. it would allow for single family home development. Feels an analysis should be done on this matter and a report brought back. to Council.as the new Justice Center and a multi-million dollar St. Francis project would soon be completed in just a few years. Mayor Henning stated studies. must be done as to the amount of water and the sewage generated with new development. Feels staff should look into theses matters in order for Council to be able to make a sound decision. Councilmember Richards spoke on consideration being given to commercial development also. Stated an analysis should be done pertaining to all of the services in the city. Also spoke on water rationing. Councilmember Heine spoke of the number of homes that were lost during the freeway construction and some of those homes need to be replaced. Councilmember Wells stated a study needed to be done before a decision should be made. Mayor Henning stated the item needs to be pulled or continued until staff brings back information on impact development would have on water and sewage in the city. Councilmember Heine discussed the issue of water rationing being dealt with at a later time and the need to go forward with this matter. After discussion, It was moved by Councilmember Rea, seconded by Mayor Henning to continue this item until information was brought back on the impact development would have on water and sewage. Item to be brought back on the 16th of April, 1991. It was moved by Councilmember Wells, seconded by Councilmember Rea, to waive reading and introduce ordinance for first reading. City Manager Gomez pulled item 16-A Resolution of the City Council 16_A of the City of Lynwood In opposition to the implementation of a Transit Transit Zone in the Southeast /Mid Cities Area. Zone Councilmember Wells requested item 19-Request from Chamber of Commerce for additional funds to cover budget shortfall. Councilmember Richards requested item 15-Amendment to Section 6-3.13 Mad y, of the Lynwood Municipal Code relating to purchasing; and item 20- budget Mid-Year budget review for fiscal year 1990-91. review Mayor Henning requested item 17-Request for City Council to consider the extension of the life of the Lynwood Project Area Committee. The following action was taken: RESOLUTION NO. 91-38 entitled: "A RESOLUTION: OF THE CITY COUNCIL R>~ ~_; r'^ OF THE CITY OF LYNWOOD AWARDING A CONSULTANT CONTRACT TO GIVENS, ~ SAIKI AND WILLIAMS CONSULTING ENGINEERS." was presented. RESOLUTION NO. 91-39 entitled: "A RESOLUTION OF THE CITY COUNCIL R~ ~ 39 OF THE CITY OF LYNWOOD AWARDING A CONTRACT TO THE LOWEST BIDDER, DENARDI CORPORATION, IN THE AMOUNT OF $48,980.14 FOR THE PURCHASE OF ONE ARTICULATED FOUR-WHEEL-DRIVE LOADER AND AUTHORIZE THE ADVERTISING FOR BIDS FOR AN ENGINE DIAGNOSTIC MACHINE." was presented. ~~ RES 91-41 RESOLUTION NO. 91 -41 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD TO APPOINT SPECIFIC REPRE- SENTATIVES TO THE INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY." was presented. RESOLUTION NO. 91-43 entitled: "A RESOLUTION OF THE CITY RES 91-43 COUNCIL OF THE CITY OF LYNWOOD APPROVING THE DEMANDS AND ORDERING WARRANTS DRAWN THEREFOR." was presented. Code on Councilmember Richards requested item 15-Amendment to section purchasing 6-3.13 of the Lynwood Municipal Code relating to purchasing, and questioned if public contracts code would limit city's flexibility in regards to purchasing. City Attorney discussed services that would be included on the. exemption list and be negotiated for. After discussion, ORDINANCE entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 6, SECTION 3.13 OF THE LYNWOOD MUNICIPAL CODE RELATING TO EXCEPTIONS TO COMPETITIVE BIDDING." was presented. It was moved by Councilmember Richards, seconded by Councilmember Wells to waive reading and introduce ordinance for first reading. ROLL CALL• AYES: COUNGILMEMBERS HEINE, NOES: NONE ABSENT: NONE REA, RICHARDS, WELLS, HENNING PAC Mayor Henning requested item 17-Consideration of extension of the life of the Lynwood Project Area Committee (PAC), and questioned if the extension to continue PAC was necessary. Community Development Director Karefa-Johnson discussed PAC City projects not being necessary after July, 1 991 , and the workshops that could be held to insure citizens being aware of the projects in process in the city. Stated the purpose of PAC was to monitor development projects. Mayor Henning stated he would rather see a newsletter go out to the citizens to let them know what is going on in the city. Councilmember Richards discussed amendment with County being in place. Requested written report from staff on the amendment. Councilmember Wells stated she would prefer having a Citizen Advisory Board Group and a newsletter go out to the community. After discussion, It was moved by Councilmember Richards, seconded by Councilmember Wells to net extend the Project Area Committee. Mayor Henning pulled item to exten the life of the Lynwood Project Area Committee, with no action. Newsletter to go out to citizens informing them of projects in progress in the city. ~ ~ ~~ Councilmember Wells requested item 19-Request from Chamber of Commerce for additional funds to cover .budget shortfall. RESOLUTION NO. 91-40 entitled: "A RESOLUTION OF THE CITY RES 91-40 COUNCIL OF THE CITY OF LYNWOOD APPROPRIATING FUNDS FROM THE GENERAL FUNDS RESERVE TO LYNWOOD CHAMBER OF COMMERCE FUNDS." was presented. It was moved by Councilmember Wells, seconded by Councilmember Heine to adopt the resolution with the amended appropriation of $6,523.00. I Councilmember Richards questioned a let er being sent from Chamber justifying the additional amount of money requested. Councilmember Wells stated there was a duplication of $500 in the statement. City Manager stated workshop meetings would be set in the near future . After discussion, RESOLUTION NO. 91-42 entitled: "A RESOLUTION OF THE CITY COUNCIL g~ 91-42 OF THE CITY OF LYNWOOD AMENDING .THE ANNUAL OPERATING BUDGET FOR ~,_. FISCAL YEAR 1990-91.p was presented. It was. moved by Councilmember Wells, seconded by Councilmember Richards to adopt the resolution. Councilmember Heine nominated Lynn Dudenhoeffer. Councilmember Wells nominated Connie Franklin. Hearing no further nominations, It was moved by Councilmember Wells, seconded by Councilmember Rea to close nominations. Councilmember Richards requested letters from the two nominees. Block Club Party for "Week of the Child" C. Church of the Cross of California for the Solicitation of Funds for Religious Purposes. Outside Councilmember Heine questioned why outside solicitors were solicitors approved to come in and take out funds from the city when there are a number of Churches in the city who could also use contributions but you don't see them standing out in front of different locations. Council was recessed at 8:32 p.m. Council was reconvened at 9:15 p.m. Mayor Henning stated personnel matters were discussed. No action reported. PUBLIC ORAL COMMUNICATIONS: L Hawkins Lorna Hawkins, 3538 Louise, spoke on behalf of the Community Affairs Commission. Showed posters geared toward helping to keep. young people out of gangs and off drugs. Mayor Henning complimented Lorna Hawkins on the fine presentation made and good job being done. Hearing no further response, It was moved by Councilmember Wells, seconded by Councilmember Rea, to close public oral communications. COUNCIL ORAL AND WRITTEN COMMUNICATIONS: Councilmember Wells spoke on the Womens Commission held on last Friday. Complimented them for a fine job being done. Councilmember Heine requested staff look into a 30ft. strip of Flshing red red curb at Norton and Santa Fe, on the North West corner. Also possible flashing red light because it is hard to see because light on of truck parking blocking vision in crosswalk. Congratulated Norton city staff in getting minutes to Council in reasonable length of time. Stated there is one city that is a year behind in 114inutes getting the minutes to Council. Also requested City Manager submitted on get price on hand held computers to be used by Sheriffs tirr~e Meterperson when ticketing on street sweeping. Funding could come from Drug Forfeiture Fund. Also spoke on meetings that Hand held have been held on city's upcoming 70th birthday celebration. computers for metexmaids Mayor Pro Tem Rea requested City Manager look into the possibility of summer youth employment for the young people in the city. Thanked Lorna Hawkins for coming and letting Sher youth Council know what was being done by her commission. Also employment spoke on the We Tip program that is now in operation in the city. Councilmember Richards extended the ratitued of the National Black Law Students Association (letter would be forthcoming to Nat, Bl,k Law City Council along with commendation, thanking city for their Stud, Assoc support and help during their convention on last week. Also spoke , of concerns young black man who had just returned from Persian Gulf, who was killed in Detroit. Stated everyone should be concerned about letting the President know help is needed. Also spoke on the Rodney King incident. ~~ ~9 Mayor Henning spoke on the Rodney King incident. Requested a letter be drafted to the District Attorney's Office to consider filing charges against those officers who stood by and watched Rodney King being beaten. Also requested letter sent to Governor and Legislatures requesting change in laws pertaining to police filing false reports to cover up a crime. Also spoke on ordinance pertaining to graffiti cleanup by businesses. Feels a time limit should be set as to their cleanup. Instructed City Manager to look into obtaining Block Watch Captains Boods to give. Mayor spoke on the numerous activities going on in the Parks and Recreation Department-.-this month. Director Parks and Recreation Mattoon spoke on Anti-..Graffiti Day, Gospel Concert, Easter Egg Hunt. Also spoke on the basketball game between Lynwood Sheriffs and Lynwood Fire Department.
