Member John Hamilton introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.00-05
RESOLUTION VACATING PORTIONS OF CEDAR STREET
WHEREAS, the city of Medina (the "City") has received requests from Kevin G. Randolph
and Karen R. Randolph; G. M. Kemp and C. D. Patton; and Dierdre D. Anderson and Don A.
Anderson, (collectively, the "Applicants") who are the fee owners of the properties at 3050, 2994
and 2990 Lakeshore Avenue, respectively, to vacate portions of Cedar Street adjacent to the
Applicants' properties; and
WHEREAS, the portions of unopened Cedar Street proposed to be vacated are depicted on
the map attached hereto as Exhibit A and are legally described on Exhibit B attached hereto; and
WHEREAS, pursuant to Minn. Stat. § 412,851, the City has scheduled a public hearing to
consider the vacation requests; and
WHEREAS, the notice of said public hearing was published twice in the official newspaper
and was mailed to the owners of other affected properties at least 10 days before the hearing all in
accordance with law; and
WHEREAS, the City has this day held the public hearing on the street vacation, at which
hearing all interested parties were heard; and
WHEREAS, following said public hearing, the City determined that the vacation of the
described portions of unopened Cedar Street to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The City hereby declares that the portions of unopened Cedar Street described on
Exhibit B attached hereto are vacated.

2. The city administrator -clerk -treasurer is authorized and directed to prepare and
present to Hennepin county a notice that the City has completed these vacation
proceedings and request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Phil Zietlow
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.

The legal description of the property to be vacated is as follows:
That part of Cedar Avenue lying between the northerly line of Lot 6, Block 14,
Independence Beach, extended easterly to the northwest corner of Lot 1, Block 13,
Independence Beach and the southerly line of Lot 6, Block 14, Independence Beach,
extended easterly to the southwest corner of Lot 1, Block 13, Independence Beach;
and
That part of Cedar Avenue lying between the northerly line of Lot 4, Block 16,
Independence Beach, extended easterly to the northwest corner of Lot 20, Block 17,
Independence Beach and the southerly line of Lot 5, Block 16, Independence Beach,
extended northeasterly to the southwest corner of Lot 20, Block 17, Independence
Beach.
