The Council discussed this item during a work session on March 26 and reviewed a draft agreement on April 22, 2010. This Agreement will allow the USFS to stop their current practice of discharging the phosphorus -laden washwater onto the ground. It will also ensure that the USFS has a feasible and cost-effective treatment method for the washwater, eliminating a potential reason for the USFS to consider relocating the air tanker operations to another community. The USFS has agreed to all of the revisions contained within the revised agreement. The Idaho Department of Environmental Quality (IDEA) is supportive of this proposal. From their perspective, it eliminates a potential pollution source and ensures proper treatment and disposal of the washwater. It is clear to all parties, however, that if the City were to resume discharge of treated wastewater into the North Fork of the Payette River, this Agreement would have to be terminated, or at least significantly modified. RECOMMENDED ACTION: Approve the Industrial User Agreement with the USFS and authorize the Mayor to sign all necessary documents.
