In the CBD, single-family dwelling units are not permitted. Accordingly, the applicant's existing single-family dwelling unit conforming use. According to Title 3, Chapter 11, non -conforming uses may not be expanded or enlarged. The requested expansion of the single-family dwelling unit constitutes an expansion of a non -conforming requiring a variance application to be considered. McCall City Code does not authorize the granting variances for use -related issues. After further review of the variance criteria, staff does not believe applicant's request meets the approval criteria for a variance. At a regularly scheduled meeting on September 2010, the McCall Area Planning and Zoning Commission recommended VAR-10-01 for denial by the City Council.
