AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI,VACATING AND DISCONTINUING
A PORTION OF STONEHILL ROAD, SOUTH OF WEATHERED ROCK ROAD AND CERTAIN
EASEMENTS RELATING TO SAID RIGHT-OF-WAY
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri that the
owners of land adjacent to and abutting upon Stonehill Road within the City have petitioned the City
Council to vacate Stonehill Road; and
WHEREAS, it has been shown that it would not inconvenience the public or the citizens of
the City to discontinue a portion of Stonehill Road for public use as described in Sections 1 and 2
of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue portions of easements for public use as described in the certain
following sections of this Ordinance.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
• SECTION 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as a street and forever vacate and relinquish the following
described right-of-way of Stonehill Road, south of Weathered Rock Road, subject to retaining an
perpetual easement or right-of way for the construction, maintenance, repair, location, relocation
and operation of all sanitary sewer, surface water and storm water drainage and conveyance
facilities, and/or public utility facilities now existing or hereafter to be constructed within said right-
of-way:
(Easement rights retained) A portion of the Right of Way known as Stonehill Road which
was previously dedicated by Plat of Record known as Millbrook Subdivision, as recorded
in Plat Book 8, Page 109, and Plat of Record known as Stonehill Section Three, as
recorded in Plat Book 12, Page 014,Cole County Recorder's Office;said right of way in the
City of Jefferson, Cole County, Missouri more particularly described as follows:
BEGINNING at the northeast corner of Lot 18 of Stonehill Section Three;thence along the
proposed southerly right of way line of Weathered Rock Road on a curve to the left have
a radius of 432.09 feet and an arc length of 61.57 feet (Ch=N68°48'23"E, 61.51 feet) to a
point on the said southerly right of way line of Weathered Rock Road as recorded in said
Millbrook Subdivision;thence southerly along the easterly right of way line of Stonehill Road
also being the westerly property line of a tract of land described in Book 385, Page 312,
Cole County Recorder's Office, S33 055'40"E,348.65 feet;thence leaving said easterly line
of Stonehill Road S56 017'24"W,5.46 feet;thence S33 042'36"E,49.42 feet;thence returning
to said easterly right of way line of Stonehill Road N56 017'24"E,5.64 feet;thence along the
said easterly right of way line of Stonehill Road S33 055'40"E, 0.40 feet; thence continuing

on a curve to the left having a radius of 344.46 feet, arc length of 51.46' (Ch=S38°12'27"E,
• 51.41 feet)to a point on the Cul-de-sac of Stonehill Road; thence continuing on a curve to
the right with a radius of 50.00 feet,arc length of 222.07 feet(Ch=S02 014'15"W,79.61 feet)
to a point on the westerly right of way line of Stonehill Road, and said point also being the
northwest corner of Lot 19 of Stonehill Section Three, and also said point being on the
easterly line of Lot 16 of Stonehill Section Three, thence continuing along the easterly line
of Lot 16 of Stonehill Section Three on a curve to the right have a radius of 404.46 feet, arc
length of 117.33 feet (Ch=N42 012'58"W, 116.92 feet); thence N33 055'40°W, 45.55 feet to
the northeast corner of Lot 16, also being the southwest corner of Lot 18 of Stonehill
Section Three; thence continuing along the easterly property line of Lot 18 of Stonehill
Section Three, N33 055'40"W, 366.33 feet to the BEGINNING POINT of this description.
SECTION 2. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as a street and forever vacate and relinquish the following
described right-of-way and related easements in the following described area of Stonehill Road,
south of Weathered Rock Road:
(Easement rights relinquished) A portion of the Right of Way known as Stonehill Road
which was previously dedicated by Plat of Record known as Millbrook Subdivision, as
recorded in Plat Book 8, Page 109, and Plat of Record known as Stonehill Section Three,
as recorded in Plat Book 12, Page 014, Cole County Recorder's Office; said right of way
in the City of Jefferson,Cole County, Missouri more particularly described as follows: From
the northeast corner of Lot 18 of Stonehill Section Three; thence along the proposed
southerly right of way line of Weathered Rock Road on a curve to the left have a radius of
432.09 feet and an arc length of 61.57 feet(Ch=N68 048'23"E, 61.51 feet)to a point on the

SECTION 3. The Council of the City of Jefferson, Missouri hereby declares it necessary,
reasonable and proper to discontinue and forever vacate and relinquish the following described
sanitary sewer easement, part of the Moreau River-Tanner Bridge Extension, described in Book
217, Page 690, Cole County Recorder's office:
A portion of an existing Sanitary Sewer Easement for the Moreau River - Tanner Bridge
Extension, as recorded in Book 217, Page 690, Cole County Recorder's Office; said
easement in the City of Jefferson, Cole County, Missouri, more particularly described as
follows: From the northwest corner of a tract of land described in Book 385, Page 312,Cole
County Recorder's Office; thence southerly along the easterly right of way line of Stonehill
Road, per Plat of record known as Millbrook Subdivision, as recorded in Plat Book 8, Page
109, Cole County Recorder's Office, S33 055'40"E, 272.62 feet to the POINT OF
BEGINNING for this description; thence continuing the following courses; S59 017'46"E,
230.15 feet;thence S31°19'14"W, 10.00 feet; thence N59 017'46"W, 208.95 feet to a point

on the easterly right of way line of said Stonehill Road; thence N33 055'40"W, 23.34 feet to
• the BEGINNING POINT of this description.
SECTION 4. The Council of the City of Jefferson, Missouri hereby declares it necessary,
reasonable and proper to discontinue and forever vacate and relinquish part of a drainage
easement originally dedicated to the Missouri Department of Transportation (MoDOT) now
maintained by the City of Jefferson,as described in Book 242, Page 700, Cole County Recorder's
Office:
A portion of a Drainage Easement dedicated to MoDOT, now maintained by the City of
Jefferson,described in Book 242,Page 700,Cole County Recorder's Office;said easement
in the City of Jefferson, Cole County Missouri, more particularly described as follows: From
a point lying on the westerly right of way line of Lorenzo Greene Drive, formerly known as
Missouri State Route B and also being the northeast corner of Lot 19 of Stonehill Section
Three, as recorded in Plat Book 12, Page 014, Cole County Recorder's Office; thence
N31°08'09"W, 9.16 feet along the said westerly right of way line of Lorenzo Greene Drive
to the northeast corner of the said Drainage Easement dedicated to MoDOT, now
maintained by the City of Jefferson, thence westerly along the northerly line of said
Drainage Easement dedicated to MoDOT, now maintained by the City of Jefferson,
S59 004'16"W, 29.05 feet to the POINT OF BEGINNING for this description; thence

reasonable and proper to discontinue and forever vacate and relinquish the following described

in the plat of record known as Stonehill Section Three, in Plat Book 12, Page 014, Cole County
Recorder's Office:
A portion of a Sanitary Sewer, Storm and General Utility Easement as shown on the Plat
of record known as Stonehill Section Three, in Plat Book 12, Page 014, Cole County
Recorder's Office; said easement in the City of Jefferson, Cole County, Missouri, more
particularly described as follows: From a point lying on the westerly right of way line of
Lorenzo Greene Drive, formerly known as Missouri State Route B and also being the
northeast corner of Lot 19 of Stonehill Section Three, as recorded in Plat Book 12, Page
014, Cole County Recorder's Office; thence southerly along the said westerly right of way
line of Lorenzo Greene Drive, S31°04'59"E, 1.29 feet to the southerly line of an existing 10'
wide sanitary sewer easement as shown on the plat of record known as Millbrook
Subdivision, as recorded in Plat Book 8, Page 109, Cole County Recorder's Office;thence
along said sanitary sewer easement S30 028'32"W, 126.34 feet to the POINT OF
BEGINNING for this description; thence on a curve to the right having a radius of 65.00
feet, arc length of 111.46 feet(Ch=S24 049'15"W, 98.30 feet);thence N44 041'00"W, 11.22
feet; thence N31 010'38"E, 7.58 feet to a point on the Cul-de-sac of Stonehill Road as per
plat of record known as Stonehill Section Three, as recorded in Plat Book 12, Page 014,
Cole County Recorder's Office; thence along said cul-de-sac right of way line on a curve
to the left having a radius of 50.00 feet and an arc length of 74.26 feet (Ch=N31 010'38"E,
67.62 feet); thence leaving said right of way line N31 010'38"E, 19.74 feet to the
BEGINNING POINT of this description.

SECTION 6. The statutory right of reversion in the owners of the abutting property is
• hereby confirmed, as is provided by the laws of the State of Missouri; furthermore, the Mayor and
the City Clerk are hereby authorized to execute all necessary instruments required to confirm the
reversionary rights of the owners of property abutting the right-of-way areas vacated,subject to the
easements retained.
SECTION 7. No permanent buildings or structures shall be located within or upon said
easements without the prior written consent of the City.
SECTION 8. This Ordinance shall take effect and be in full force from and after its
passage.

Subject: Request for Right of Way Vacation of a portion of Stonehill Road.
Staff has received a request for the vacation of all of the Stonehill Road right of way which lies
to the south of Weathered Rock Road. The area in question may be seen and is described in
the attached drawing.
The land in question was originally platted in 1974 as a through street, and was replatted in
1998 as a cul-de-sac and was constructed in that fashion. At the present time Midwest
Independent Bank is the owner of all the property to the east and south of the road, and is
seeking the vacation in order to expand their business, as can be seen in the attached site
• plan. The request is not opposed by the landowners to the west as they have access from
Weathered Rock Court.
There are existing water and gas utilities in the right of way which will, according to the
submitted request, receive dedicated easements. Easements for stormwater and sanitary
sewer are already shown on the request.
Staff would support the vacation of the right of way as described and shown on the attached
documents.

AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI,VACATING AND DISCONTINUING
A PORTION OF STONEHILL ROAD, SOUTH OF WEATHERED ROCK ROAD AND CERTAIN
EASEMENTS RELATING TO SAID RIGHT-OF-WAY
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri that the
owners of land adjacent to and abutting upon Stonehill Road within the City have petitioned the City
Council to vacate Stonehill Road; and
WHEREAS, it has been shown that it would not inconvenience the public or the citizens of
_the City to discontinue a portion of Stonehill Road for public use as described in Sections 1 and 2
of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue portions of easements for public use as described in the certain
following sections of this Ordinance.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as a street and forever vacate and relinquish the following
described right-of-way of Stonehill Road, south of Weathered Rock Road, subject to retaining an
perpetual easement or right-of way for the construction, maintenance, repair, location, relocation
and operation of all sanitary sewer, surface water and storm water drainage and conveyance
facilities, and/or public utility facilities now existing or hereafter to be constructed within said right-
of-way:
(Easement rights retained) A portion of the Right of Way known as Stonehill Road which
was previously dedicated by Plat of Record known as Millbrook Subdivision, as recorded
in Plat Book 8, Page 109, and Plat of Record known as Stonehill Section Three, as
recorded in Plat Book 12, Page 014, Cole County Recorder's Office; said right of way in the
City of Jefferson, Cole County, Missouri more particularly described as follows:
BEGINNING at the northeast corner of Lot 18 of Stonehill Section Three; thence along the
proposed southerly right of way line of Weathered Rock Road on a curve to the left have
a radius of 432.09 feet and an arc length of 61.57 feet (Ch=N68°48'23"E, 61.51 feet)to a
point on the said southerly right of way line of Weathered Rock Road as recorded in said
Millbrook Subdivision;thence southerly along the easterly right of way line of Stonehill Road
also being the westerly property line of a tract of land described in Book 385, Page 312,
Cole County Recorder's Office, S33 055'40"E,348.65 feet;thence leaving said easterly line
of Stonehill Road S56 017'24"W,5.46 feet;thence S33 042'36"E,49.42 feet;thence returning
to said easterly right of way line of Stonehill Road N56 017'24"E,5.64 feet;thence along the
said easterly right of way line of Stonehill Road S33 055'40"E, 0.40 feet; thence continuing

• on a curve to the left having a radius of 344.46 feet, arc length of 51.46' (Ch=S38 012'27"E,
51.41 feet)to a point on the Cul-de-sac of Stonehill Road; thence continuing on a curve to
the right with a radius of 50.00 feet,arc length of 222.07 feet(Ch=S02 014'15"W,79.61 feet)
to a point on the westerly right of way line of Stonehill Road, and said point also being the
northwest corner of Lot 19 of Stonehill Section Three, and also said point being on the
easterly line of Lot 16 of Stonehill Section Three, thence continuing along the easterly line
of Lot 16 of Stonehill Section Three on a curve to the right have a radius of 404.46 feet, arc
length of 117.33 feet(Ch=N42 012'58"W, 116.92 feet); thence N33 055'40"W, 45.55 feet to
the northeast corner of Lot 16, also being the southwest corner of Lot 18 of Stonehill
Section Three; thence continuing along the easterly property line of Lot 18 of Stonehill
Section Three, N33 055'40"W, 366.33 feet to the BEGINNING POINT of this description.
SECTION 2. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as a street and forever vacate and relinquish the following
described right-of-way and related easements in the following described area of Stonehill Road,
south of Weathered Rock Road:
(Easement rights relinquished) A portion of the Right of Way known as Stonehill Road
which was previously dedicated by Plat of Record known as Millbrook Subdivision, as
recorded in Plat Book 8, Page 109, and Plat of Record known as Stonehill Section Three,
as recorded in Plat Book 12, Page 014, Cole County Recorder's Office; said right of way
in the City of Jefferson, Cole County, Missouri more particularly described as follows: From
the northeast corner of Lot 18 of Stonehill Section Three; thence along the proposed
southerly right of way line of Weathered Rock Road on a curve to the left have a radius of
• 432.09 feet and an arc length of 61.57 feet (Ch=N68 048'23"E, 61.51 feet)to a point on the
said southerly right of way line of Weathered Rock Road as recorded in said Millbrook

Stonehill Road N33 055'40"W, 49.42 feet to the BEGINNING POINT of this Description.
SECTION 3. The Council of the City of Jefferson, Missouri hereby declares it necessary,
reasonable and proper to discontinue and forever vacate and relinquish the following described
sanitary sewer easement, part of the Moreau River-Tanner Bridge Extension, described in Book
217, Page 690, Cole County Recorder's office:
A portion of an existing Sanitary Sewer Easement for the Moreau River - Tanner Bridge
Extension, as recorded in Book 217, Page 690, Cole County Recorder's Office; said
easement in the City of Jefferson, Cole County, Missouri, more particularly described as
follows: From the northwest corner of a tract of land described in Book 385, Page 312,Cole
County Recorder's Office; thence southerly along the easterly right of way line of Stonehill
Road, per Plat of record known as Millbrook Subdivision, as recorded in Plat Book 8, Page
109, Cole County Recorder's Office, S33 055'40"E, 272.62 feet to the POINT OF
BEGINNING for this description; thence continuing the following courses; S59 017'46"E,
230.15 feet;thence S31°19'14"W, 10.00 feet;thence N59 017'46"W, 208.95 feet to a point

• on the easterly right of way line of said Stonehill Road; thence N33°55'40"W, 23.34 feet to
the BEGINNING POINT of this description.
SECTION 4. The Council of the City of Jefferson, Missouri hereby declares it necessary,
reasonable and proper to discontinue and forever vacate and relinquish part of a drainage
easement originally dedicated to the Missouri Department of Transportation (MoDOT) now
maintained by the City of Jefferson,as described in Book 242, Page 700, Cole County Recorder's
Office:
A portion of a Drainage Easement dedicated to MoDOT, now maintained by the City of
Jefferson,described in Book 242, Page 700,Cole County Recorder's Office;said easement
in the City of Jefferson,Cole County Missouri, more particularly described as follows: From
a point lying on the westerly right of way line of Lorenzo Greene Drive, formerly known as
Missouri State Route B and also being the northeast corner of Lot 19 of Stonehill Section
Three, as recorded in Plat Book 12, Page 014, Cole County Recorder's Office; thence
N31°08'09"W, 9.16 feet along the said westerly right of way line of Lorenzo Greene Drive
to the northeast corner of the said Drainage Easement dedicated to MoDOT, now
maintained by the City of Jefferson, thence westerly along the northerly line of said
Drainage Easement dedicated to MoDOT, now maintained by the City of Jefferson,
S59 004'16"W, 29.05 feet to the POINT OF BEGINNING for this description; thence
S39 022'43"W, 139.02 feet;thence N30 055'44"W, 46.85 feet;thence N59 004'16"E, 130.89
feet to the BEGINNING POINT of this description.
SECTION 5. The Council of the City of Jefferson, Missouri hereby declares it necessary,
• reasonable and proper to discontinue and forever vacate and relinquish the following described
easement, which is part of a sanitary sewer, storm water and general utility easement as shown
in the plat of record known as Stonehill Section Three, in Plat Book 12, Page 014, Cole County
Recorder's Office:
A portion of a Sanitary Sewer, Storm and General Utility Easement as shown on the Plat
of record known as Stonehill Section Three, in Plat Book 12, Page 014, Cole County
Recorder's Office; said easement in the City of Jefferson, Cole County, Missouri, more
particularly described as follows: From a point lying on the westerly right of way line of
Lorenzo Greene Drive, formerly known as Missouri State Route B and also being the
northeast corner of Lot 19 of Stonehill Section Three, as recorded in Plat Book 12, Page
014, Cole County Recorder's Office; thence southerly along the said westerly right of way
line of Lorenzo Greene Drive, S31°04'59"E, 1.29 feet to the southerly line of an existing 10'
wide sanitary sewer easement as shown on the plat of record known as Millbrook
Subdivision, as recorded in Plat Book 8, Page 109, Cole County Recorder's Office; thence
along said sanitary sewer easement S30 028'32"W, 126.34 feet to the POINT OF
BEGINNING for this description; thence on a curve to the right having a radius of 65.00
feet,arc length of 11 1.46 feet(Ch=S24°49'15"W, 98.30 feet);thence N44 041'00"W, 11.22
feet; thence N31°10'38"E, 7.58 feet to a point on the Cul-de-sac of Stonehill Road as per
plat of record known as Stonehill Section Three, as recorded in Plat Book 12, Page 014,
Cole County Recorder's Office; thence along said cul-de-sac right of way line on a curve
to the left having a radius of 50.00 feet and an arc length of 74.26 feet(Ch=N31°10'38"E,
67.62 feet); thence leaving said right of way line N31 010'38"E, 19.74 feet to the
BEGINNING POINT of this description.

SECTION 6. The statutory right of reversion in the owners of the abutting property is
hereby confirmed, as is provided by the laws of the State of Missouri; furthermore,the Mayor and
the City Clerk are hereby authorized to execute all necessary instruments required to confirm the
reversionary rights of the owners of property abutting the right-of-way areas vacated,subject to the
easements retained.
SECTION 7. No permanent buildings or structures shall be located within or upon said
easements without the prior written consent of the City.
SECTION 8. This Ordinance shall take effect and be in full force from and after its
passage.
