HomeMy Public PortalAbout2000-010 Resolution Granting Setback Variances to Jeannie Didier and Darryl Schumann for 2992 Ardmore Avenue23 Member Jim Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.00-10 RESOLUTION GRANTING SETBACK VARIANCES TO JEANNIE DIDIER AND DARRYL SCHUMANN FOR 2992 ARDMORE AVENUE WHEREAS, Jeannie Didier and Darryl Schumann (the "Applicants") are the fee owners of property located at 2992 Ardmore Avenue, which property is legally described as Lots 1 and 2 and the north 30 feet of Lot 3, Block 21, Independence Beach, Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicants have requested permission to construct a new single family house on the Property and to locate the house within 15.5 feet of the front lot line and within 51.88 feet of the ordinary high water mark of Lake Ardmore; and WHEREAS, the city's zoning ordinance requires a minimum front yard setback in the urban residential district of 30 feet and the shoreland ordinance requires a minimum setback from the ordinary high water mark of 75 feet; and WHEREAS, the Applicants have applied for variances from the above ordinance requirements for construction of the proposed house on the Property; and WHEREAS, this matter was reviewed by the planning commission at its meeting of March 14, 2000 and by the city council at its meeting of March 21, 2000. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that the following setback variances are hereby granted to the Applicants for the construction of a single family residential dwelling on the Property: a) reduce front yard setback from 30 feet to 15.5 feet; and b) reduce setback from the ordinary high water mark of Lake Ardmore from 75 feet to RHB-177971 v 1 ME230-8 23 00-10 04-04-00 24 51.88 feet, subject to the following terms and conditions: 1. All previous buildings, foundations and debris must be removed from the Property prior to the issuance of a building permit for the new single family house; 2. All materials must be removed from the nearby city property prior to issuance of a building permit for the new single family house; 3. A dumpster must be placed on the Property and used during construction; 4. Silt fencing must be installed on the Property at the direction of the city staff before any construction or removal of debris is initiated; 5. A survey of the Property and single family home must be prepared which establishes that all habitable areas of the house are at least 3 feet above the elevation of the 100 year floodplain; 6. The Applicants must pay to the city an administrative fee in an amount necessary to reimburse the city for the cost of reviewing and approving this application; and 7. The variances hereby granted must be utilized within one year of the date of adoption of this resolution or the approval hereby granted shall be null and void. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that the above stated variances are justified by the hardship represented by the size of the existing lot.
