HomeMy Public PortalAbout1985-12-10 MeetingAttest: 7 r--F f/,A67 / Village Clerk COUNCIL MINUTES December 10, 1985 November 26, 1985 The Council of Bal Harbour Village met Tuesday, December 10, 1985 at 9:30 A.M. in the Village Hall. Present: Mrs. Antiles, Messrs. Laikin, McKeehan and Sherman Absent: Mr. Taplin Also present were Louise Miller, Village Manager; Mary Wetterer, Village Clerk; and Alan Gold, Village Attorney. On motion of Mrs. Antiles, seconded by Mr. McKeehan and voted the minutes of November 26, 1985 were approved as submitted. Mayor Sherman said that the village is like a family and it causes pain when an officer dies. Chief Fowler, President of the Dade County Association of Chiefs of Police is here to pay tribute to Officer Melendez. Chief Fowler then presented the Medal of Valor and Meritorious Service:Award to his widow, Bianca Melendez. Mr. Sherman said that engraved plaques for Officer Melendez and Sgt. Staab, who was murdered in 1957, had been donated by Tony Melucci in Hollywood and would be hung in the Police Department. The Village Manager reported that four firms had applied for the position of Village Attorney and that she had met with the representative of the firm who would represent the Village. On the basis of the interviews and ex- pertise of the firms, she selected Mr. Richard Weiss of the firm of Fine, Jacob- son, Schwartz, Masa, Block, England, P.A. Mr. Weiss gave a brief outline of his qualifications and of the firm. On motion of Mrs. Antiles, seconded by Mr. Laikin and unanimously voted the Manager's recommendation was approved. Mr. Sherman said at times our water pressure falls and it would be a dangerous situation if there was a major fire during one of these times. Mr. Gold explained that an Agreement had been prepared by the City of North Miami Beach incorporating suggestions made by theDade County Water and Sewer Authority, defining "emergency". WASA wishes it to be submitted to the City of Miami Beach and Bay Harbor Islands, all parties to the water system. Mr. Gold recommends passing the Agreement, sending it on to the City of Miami Beach and Bay Harbor Islands, and if no objections, send it back to the City of North Miami Beach. On motion of Mr. McKeehan, seconded by Mrs. Antiles, and unanimously voted the Agreement was passed. The Council discussed the condition of the Beau Rivage demolition job. Suggestions were made as to the type of fencing that should be placed on December 10,1985 the site, screening with silver buttonwood bushes and time to be allowed for a demolition job. Mr. Gold advised that any ordinance, if prepared, would have to apply to all properties and be very specific in details. It was suggested that the Village Manager contact the owners of the property in New York and see what they are willing to do regarding the condition of the property. Mr. Desharnais said that the attorney for the owner wrote to say they would cooperate as soon as the demolition contractor has left the job. Mrs. Miller reported that the village had to purchase a new engine for one of the garbage trucks. She had a bid from Palmetto Truck Sales for $3,100. The truck is now back in service. Mr. Gold Advised that there is a tax protest against Dade County from the Balmoral Apartments and Dade County thinks the Village should intervene. We will not be a full time advocate. Inasmuch as we are part of it as our tax revenue depends on the Dade County valuation, the Court will allow us to state our position. There are two ways of entering the suit. One, we can partake and be represented by counsel or we can partake to show our interest and let the Dade County Attorney represent the Village's interest. We have entered past suits both ways and have been successful. It was moved by Mr. McKeehan, seconded by Mrs. Antiles and unanimously voted that Bal Harbour should intervene in the suit. Mr. Desharnais presented the application of Hyde Park Associates for a non-use variance to light address signs at 20-30 Park Drive and 70-80 Park Drive from within rather than by floodlight. He said he has no objection to it and the signs will conform to others on Collins Avenue. Also elimina- tion by flood light helps for grass cutting. It was moved by Mr. Mckeehan, seconded by Mrs. Antiles, and unanimously voted to grant the variance. Mr. Mckeehan said he thinks Park Drive is too dark and believes the trees should be cut down and thinned across from the apartments. Mrs. Miller said she had a complaint from one of the buildings saying that the trees were too thin. Possibly more street lights could be put in. Mr. Sherman said the Resort Tax Advisory Committee meets every two weep &since the taxes are declining they are trying to see what can be done to bring in more tourists. European tourists, particularly the Germans, seem to be the best market. Mr. Cliff and Mr. Alden recommended a Mr. Hans Regh to contact agents in Switzerland and Germany to get a new market. His fee would be $12,000 a year, plus expenses which would amount to $20,000 a year for his contract. It was moved by Mr. Mckeehan, seconded by Mr. Laikin and unanimously voted to enter into a one year contract with Mr. Regh Associates, the money to come from Resort Taxes. Mr. Kelly, Finance Director, said we must do something to increase revenue to meet the Tourism Department budget. The returns are down 4%, not including the 7% loss from the Beau Rivage. Mr. Sherman said that the Resort Tax Advisory Committee should invite the Shop owners to their meetings and show them the figures. Mrs. Miller reported that they are trying to re -install the bus benches within the next few days so to provide some seating. The Council was invited to have lunch at the Village Hall with all the employees on Tuesday, December 24th. Mr. Sherman presented a plaque to Mr. Gold for his ten years as Village Attorney. Mr. Gold said he wished to express his appreciation to the Mayor December 10, 1985 and Village Council and Louise and Mary. He has seen many municipalities over the State in various ways and that Bal Harbour is well run. It was a pleasure to have worked with all. He feels very comfortable in passing the position on to Mr. Weiss and wishes the Council and Village much success in its endeavors. Mr. Sherman said as this is the last meeting in 1985 he wishes the Council, Manager and employees very happy holidays. It has been a pleasure working with the new Manager. On motion of Mrs. Antiles, seconded by Mr. Laikin and voted the meet- ing was adjourned at 10:40 A.M. Attest: Village Clerk COUNCIL MINUTES January 28, 1986 December 10, 1985 The Council of Bal Harbour Village met Tuesday, January 28, 1986 at 9:30 A.M. in the Village Hall. Present: Mrs. Antiles, Messrs. McKeehan, Sherman and Taplin Absent: Mr. Laikin Also present were Louise Miller, Village Manager; Mary Wetterer, Village Clerk and Richard Weiss, Village Attorney. On motion of Mrs. Antiles, seconded by Mr. McKeehan and voted the minutes of December 10, 1985 were approved as submitted. Mayor Sherman said that four months ago the council agreed to the concept of having smoke alarms connect to a central annunciator panel in high rises. Mr. Sherman introduced our new village attorney, Richard Weiss. Mr. Weiss ex- plained the provisions of the proposed ordinance. The council discussed with George Desharnais, Building Official, the results of meeting held with the rep- resentatives of the buildings involved, the method of placing the detectors, and number of companies providing the system. The proposed ordinance would be amended to reflect its application to buildings of four or more stories, provide for installation within six months, and a schedule reflecting time periods for fines. Mrs. Miller said the ordinance should provide for a one time permit fee for the initial inspection by our inspector. On motion of Mr. Taplin, seconded by Mrs. Antiles and unanimously voted the ordinance, as amended above, was passed on first reading. Mr. Sherman explained that suits against public officials have escalated and steps must be taken to protect the officials. Finance Director, John Kelly said that we need additional insurance as our official's liability policy does not cover the Building Official or slander and libel. January 28, 1986
