Member Carolyn Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.00-16
RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 318 BY TITLE AND SUMMARY
WHEREAS, the city council of the city of Medina has adopted Ordinance No. 318, an
ordinance revising the City's ordinance related to individual sewage treatment systems (ISTS); and
WHEREAS, the ISTS amendment is 4 pages in length; and
WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the amendment to the ISTS.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that
the city administrator -clerk -treasurer shall cause the following summary of Ordinance No. 318 to be
published in the official newspaper in lieu of the entire ordinance:
Public Notice
The city council of the city of Medina has adopted Ordinance No. 318. The ordinance
amends section 720 of the city's code of ordinances regarding individual sewage treatment systems
(ISTS). The ordinance was adopted in connection with the city's efforts to amend its
comprehensive plan. The city's ISTS ordinance generally adopts state regulations regarding septic
systems. The amendment adds a requirement that the owners of properties served by an ISTS must
assess their system every three years and perform maintenance or repairs if necessary. The city is
authorized to assess systems and require maintenance if a property owner fails to do so. ISTS which
are found to pose an imminent health hazard must be replaced within no more than 10 months.
Failing systems must be repaired or replaced within three years. The full text of Ordinance No. 318

BE IT FURTHER RESOLVED by the city council of the city of Medina that the city
administrator -clerk -treasurer keep a copy of the ordinance in his office at city hall for public
inspection and that he post a full copy of the ordinance in a public place within the city.

The motion for the adoption of the foregoing resolution was duly seconded by Phil Zietlow and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Smith, and Zietlow
and the following voted against same: None Absent: Johnson(arrived after approval)
Whereupon said resolution was declared duly passed and adopted.
