SUMMARY STATEMENT:
The applicant has submitted an application for a new beach club located at 607, 609, and 611 Owen Drive.
A public hearing was held by Planning and Zoning Commission on December 7, 2010. The application was then
continued to the February 8, 2011 meeting to allow time for the applicant to hold an additional neighborhood
hearing and to develop additional materials with more specificity. At the February 8 meeting another public hearing
occurred and the Commission ultimately recommended the application for denial by the City Council.
The application was noticed for the March 10 City Council meeting. However, after the notice for the City Council
meeting was published it was discovered that the City did not have a complete transcribable record of the
proceedings from February 8 meeting — only part of the application's hearing was recorded. After conferring with
Bill Nichols, it was determined that the hearing for CUP-10-07 before the Commission needed to be redone before
the application could be considered by the Council to be in compliance with state statute regarding public hearings.
This process and new schedule has been explained to the applicant and the neighbors. The "redo" meeting is
scheduled for the April 5 Commission meeting.
Since the appropriate public process has not been followed to -date, staff is hereby recommending that the Council
remand the application back to the Commission so that the appropriate process can be followed. No information on
the project has been provided in the packet but the full land use file is available at City Hall, 216 E. Park Street,
McCall, Idaho 83638, during normal business hours.
RECOMMENDED ACTION:
Remand CUP-10-07 back to the McCall Area Planning and Zoning Commission.
