SUMMARY STATEMENT:
Council Member Delaney resigned from the City Council, effective March 11, 2011. Staff has advertised
the vacancy in the Star News, to advisory committee members, and on the City's website. As of March
18, five letters of interest have been received. Attached are letters of interest from Ramon (Ray) L. Alford,
James E. Betts, John Cady, Robert Lyons, and Ballard Smith.
Idaho Code § 50-704 provides the authority for filling a vacancy on the Council.
50-704. VACANCIES -- APPOINTMENT. A vacancy on the council shall be filled by appointment made
by the mayor with the consent of the council, which appointee shall serve only until the next general city
election, at which such vacancy shall be filled for the balance of the original term.
McCall City Code § 1-8-6 outlines a slightly more involved process than IC § 50-704.
1-8-6. PROCEDURES FOR FILLING VACANCIES ON COUNCIL. In the event a vacancy exists in the
membership of the council, the council shall adopt a motion to meet as a committee of the whole. The
committee of the whole shall consider the matter of an appointment to fill such vacancy, make a
recommendation to the mayor and adjourn. The council then having been called back into its session, the
mayor shall appoint such person as was recommended by the committee of the whole; the mayor may
vote against confirmation of that appointment if the mayor chooses to do so.
The next general city election will be held on November 8, 2011. Council Member Delaney's term would
have expired on December 31, 2014. Therefore, this appointment will be until November, and a Council
Member will be elected then to fill a two year term.
RECOMMENDED ACTION:
Fill the vacancy on the McCall City Council pursuant to MCC 1-8-6.
