Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.00-21
RESOLUTION GRANTING FINAL APPROVAL TO THE
PLAT OF WHISPERING PINES
WHEREAS, Steven J. Ruchti (the "Applicant") is the fee owner of property located at 1252
Deerhill Road; and
WHEREAS, the Applicant has requested permission to plat his property as Whispering
Pines; and
WHEREAS, the planning commission has reviewed the application and the city council
granted preliminary approval of said plat at its meeting on May 16, 2000; and
WHEREAS, the Applicant has now prepared the final plat of Whispering Pines in
accordance with preliminary plat approval and in compliance with the ordinances and requirements
of the city.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that final approval is hereby granted to the Applicant for the plat of Whispering Pines,
subject to the following terms and conditions:
1. The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing this application;
2. The parties acknowledge that there are two accessory structures on the property
which do not meet setback requirements and are therefore non -conforming and which may also be
located within the drainage and utility easement dedicated on the plat; and
3. The Applicant must file the final plat of Whispering Pines with Hennepin County
within 60 days of the date of this resolution or the approval hereby granted shall be null and void.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina that the mayor and clerk -treasurer -administrator are not authorized to execute the plat of
Whispering Pines until notified by the city attorney that the Applicant has provided recorded
evidence of the name change from Chemical Residential Mortgage Corporation to Chase Manhattan
Mortgage Corporation and City -County Federal Credit Union has executed the plat or has executed
a Consent to Plat in a form acceptable to the city attorney;

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
