AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING 2.54 ACRES FROM RU RURAL USE TO RS-1 SINGLE FAMILY RESIDENTIAL, FOR
LAND ADDRESSED AS 3030 ROUTE J, DESCRIBED AS PART OF SECTION 29, TOWNSHIP 44
NORTH, RANGE 10 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RU Rural Use to RS-1 Single
Family Residential:
That portion of the following described tract of land, described in Book 319, Page 405, Cole
County Recorders Office, that lies within the Northeast quarter of the Northwest quarter of
Section 29,Township 44, Range 10,Jefferson City, Cole County, Missouri,and lies north and
west of Missouri Route J:
The Northeast quarter of the Northwest quarter and the Southwest quarter of the Northwest
quarter,all in Section 29,Township 44, Range 10,Cole County, Missouri,containing 80 acres,
more or less; Except that part of the Southwest quarter of the Northwest quarter and that
• part of the Northeast quarter of the Northwest quarter of Section 29, Township 44, Range 10,
conveyed to the State of Missouri,for Supplementary State Highway Route J, by conveyance
of record in Book 94, page 40, Cole County Recorder's Office; and Except that part of the
Southwest quarter of the Northwest quarter of Section 29,Township 44, Range 10, conveyed
to the State of Missouri,for Supplementary State Highway Route J,by deed of record in Book
230,page 132,Cole County Recorder's Office;and Except 0.66 of an acre, more or less, part

described as follows: From the northeast corner of the Southwest quarter of the Northwest
quarter of said Section 29; thence South 89 degrees 29 minutes west along the north line of
said quarter quarter section, 1058.5 feet to a point on the easterly right-of-way line of
Supplementary State Highway Route J and the beginning point of this description; thence
North 89 degrees 29 minutes east along the north line of said quarter quarter section 248.0
feet; thence South 1 degree 32 minutes east, 299.62 feet; thence South 87 degrees 18
minutes west, 316.4 feet to a point on said easterly right-of-way line; thence northeasterly
along said easterly right-of-way line, 315.75 feet to the beginning point of this description.

18, 2008 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320 East
McCarty Street,to consider rezoning land addressed as 3030 Route J from RU Rural Use to RS-1
Single Family Residential:
Section 1. Property Description: That portion of the following described tract of land,

Case No. P08018 — 3030 Route J; Rezoning. Request filed by Russell and Vickie Mueller,
property owners, to rezone approximately 2.5 acres from RU Rural to RS-1 Single Family
Residential. The property is located on the western side of Route J approximately 900 feet north of
Algoa Road and is described as part of Section 29, Township 44 North, Range 10 West, City of
Jefferson, Cole County, Missouri.
Mr. Russell Mueller, 3307 Route J, spoke regarding this request and explained that the
purpose of this request is to construct a single family residential development on the subject
property.
No one spoke in opposition to this request.
Mr. Barron gave the Planning Division staff report and explained that the subject property
and surrounding properties within the city limits are zoned for agricultural use. He stated that
this area was part of the Algoa annexation area in November, 2003. Mr. Barron explained that
much of the property located along Route J is developed as single family residential and the
area lends itself well to further single family residential construction.
Mr. Yarnell moved and Mr. Bickel seconded to recommend approval of the rezoning request
for 3030 Route J, to the City Council. The motion passed 8-0 with the following votes:

Origin of Request: Property Owners through the Planning and Zoning Commission
Summary: Standard ordinance amending the Zoning Atlas.
Background Information:The subject property is a vacant tract located on the north/west side of
Route J approximately 900 feet north of Algoa Road. The purpose of the rezoning request is to
support the development of a single family home. Please refer to the attached planning staff report
for additional information.
Planning and Zoning Commission Review
The Planning and Zoning Commission reviewed the application for rezoning at their meeting
of July 10, 2008. The motion to approve PASSED on a vote of 8 in favor, 0 against.
Public Notice
Standard public notice procedures were followed in advance of the Planning and Zoning
Commission meeting and the City Council meetings. This includes (1) publication of the public
notice agenda in the Jefferson City Post Tribune 15 days in advance of the hearing on the case;
(2) notification by letter to adjoining and affected property owners within 185 feet, and other
interested parties; and (3) posting of a sign on the property announcing the date and time of the
hearing on the case 10 to 15 days in advance of the hearing.
