WHEREAS, under the provisions of Article 2, Chapter 22, Pa.rt 3 of Division 7 of the Streets and Highways Code of the State of California. (Improvement Act of 1911), the Superintendent of Streets of the City of Lynwood did duly a.nd regularly notify the respective owners or persons in possession o£ the respective properties described in the report of sa.id Street Superintendent, ' hereina.fter referred to, tha.t the sidewa.lk or drive approa,ch in front of such respective properties was out of repair and notifying such owners or persons in possession to repair same, a.11 in the manner as contempla.ted in said la.w above referred to; and WHEREAS, thereafter said owners or persons in possession of said respective properties fa.iled to make such repairs within 0 the time contemplated by law or at a.11; and WHEREAS, thereafter the said Superintendent of Streets did ca.use the respective repairs to be made to the sidewalk in front of such respective properties and did keep a record of the cost of such repa.irs, including the incidental expenses thereof, and did prepa.re and file with the said City Council a report specifying the repairs which had been so made, the cost of such repairs, and a description of ea.ch parcel of real property in front of which such repairs ha.d been ma.de and the assessment against ea.ch lot or parcel of land proposed to be levied to pay the cost thereof; and ,_ � , - • WHEREAS, as contemplated by law, said Superintendent of Streets did cause notice of the said cost of such repaire to be - mailed to the respective owners or persons in possession of said respective properties, and did in such notices give further notice that on the 15th day of June 1965 beginning at the hour of 7:3� \ r -- . o'clock p.m, in the Council Chamber of the City Ha.11 of the City of Lynwood, Ca.lifornia, the Council of sa.id city would hear and pass upon the said report of the Superintendent of Streets of the said cost of such repairs, together with any objections or protests which might be raised by a.ny property owner liable to be a.ssessed for the cost a.nd incidental expenses of making such repairs, and the ob�ections or protests of any other interested persons; and WHEREAS, on the said 15th day of June, 1965, sa.id City Council did proceed to hold said hearing and did duly and regularly conduct the same all as contemplated by la.w; a.nd WHEREAS, no protests or objections of any kind were made, presented, or filed in such matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, AETERMINE, AND ORDER AS FOLLOir1S : Section l. That the facts with reference to said ma,tter a.s recitecl in the preamble to this resolution are true. Section 2. That said City Council does hereby confirm the report of sa.id Street Superintendent which is on £ile in the office of the City Clerk of said City and open to public inspection, and which is referred to and incorporated by reference herein. Section 3. That the said Council does hereby assess the respective costs of said repairs against the respective pa.rcels of real property fronting upon the sidewalk upon which such respective repairs were made, all in the respective amounts,' for the respective purposes and against the respective properties as set forth a.nd indicated in sa,id report of said Superintendent of Streets on file as aforesaid, a.nd does hereby order that unless the sa.id respective amounts so assessed are respectively paicl within the time limited by law, the sa.id respective amounts sha.11 constitute and be and are hereby respectively levied by said Council as respective _ 2 _ � I �' � + special assessment against the sa.id respective parcela of real proper.ties for the respective ambunts, all as set forth in said report hereinabove quoted, and as contemplated under the provisions of said Chapter 22 of Past 3,'of Division 7 of sa.id S�reets and . Highways Code, which said respective liens shall respectively � continue until the respective assessments and all respective interest a.mounts thereon a.re respectively paid, or until they are respective,ly discharged o£ record. � Section 4. That said Couneil does hereby elect to proceed w�der the alternative method of collection provided for under the provisions of Section 5728 of said Law (Improvement Act of 1911) hereina.bove referred to and does hereby authorize, instruct, and order�that the Notice of •Z�ien shall be de,livered to the County Auditor of Los Angeles County, Cali£ornia, who shall enter the amount thereof on the County As,sessment Book opposite the,description of the particular property, and the amount shall be collected together �- with all other taxes thereon against the property. Sa,id County Auditor, and the Assessor, and the Tax Collector of said County of _ Los Angeles who perform tax assessing and tax collection functions for the City o£ Lynwood a.re kzereby authorized, instructed, directed, and ordered to take any and all action necessary or proper on their respective parts, all as contemplated under the provisions of the laws of the State of Cali£ornia in such cases made and provided. ' Section 5. Said County Assessor, said County Tax Collector, and said County Auditor are hereby authorized, instructed, directed, � and ordered, upon receipt of such notices of lien, to receive the sa.me and therea£ter proceed to a.dd the respective amounts of the respeative assessments indicated in sa.id respective notices of lien as hereinabove set £orth in said above,report of said Street Superintendent, to the next regular bill for taxes levied against - 3 - • , i ' � • I the respective lots or parcels of land therein described or referred to, and to enter the respective amount thereof on the County Assess- ment Book opposite the respective description of the respective particula.r properties described and referred to in sa.ia respective notices of lien a.s set forth in said report, and the respective a.mounts thereof shall be collected with all otY� r taxes thereon against the,respective properties described. Sa.id County Officers, and ea.ch of.them, are hereby further authorized, instructed, directed, and ordered to perform any further a,cts on their respective parts, all as contemplated under the law in such cases mac�e and provided. Section 6. Tha,t this reaolution shall tal:e effect immediately. Section 7• That the City Clerk sha.11 certii'y to the passage,and adoption of this resolution; shall make a minute of the passage and adoption thereo£ in the,records of the proceedings of ' � .the City Council of said City in the minutes ofthe meeting at which ' time the same is passed and adopted; shall enter the same in the Book of origina.l reaolutions of sa,id city; a.nd sha.11 cause a certified copy thereof to be delivered to each of said respective County Officers above named.
