SUMMARY STATEMENT:
New legislation went into effect on January 1, 2011 that establishes counties as the
elections. Idaho Code §34-1205 and §34-1206 state that the county board of commissioners
county board of canvassers and the county clerk shall serve as their secretary for this
board shall examine and make a statement of the total number of votes cast for all candidates
questions that shall have been voted upon at the election. Attached is the Valley
Commissioners canvass results of the May 17, 2011 Special Election for Local Option
Idaho Code §50-1046 requires that a 60 percent majority of voters approve a local option
measure.

Also attached is Resolution 11-13 which ratifies the County Commissioners canvass of

RECOMMENDED ACTION:
Adopt Resolution 11-13 ratifying the Valley County Commissioners canvass of the May 17, 2011 Special
Election for Local Option Tax and authorize the Mayor to sign all necessary documents.
