CALL TO ORDER: Mayor Gillanders called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, March 20, 1984, in the Council Cham- ber of the City Hall. 2. The invocation was given by Dr. Ed Linberg, Temple City Christian Church, 9723 Garibaldi. 3. The Pledge of Allegiance to the Flag was led by Mayor Gillanders. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Swain, Tyrell, Gillanders Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett, Julie Estrada, Temple City Times, and Clint Lyons, The Temple City Pacesetter. 5. CONSENT CALENDAR: Councilwoman Swain requested that Item C(2) be removed from the Consent Calendar. On motion by Councilman Dennis and seconded by Councilman Atkins all other items on the Consent Calendar were approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of March 6, 1984. Approved as written with Councilman Tyrell abstaining. B. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF MARCH 7, 1984 STOP SIGN - LA ROSA DRIVE AT ARDEN DRIVE Approved Traffic Commission recommendation for placement of boulevard stop sign with stop and bar pavement markings on La Rosa Drive at the east approach to Arden Drive. C. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF 3/13/84 (1) PROPERTY NUISANCE CASE 84 -108 (4950 McClintock Avenue) Adopted Resolution No. 84 -2251 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF. (3) PLANNING COMMISSION ACTION Approved and filed memo from Planning Colluaission relating to action taken at their regular meeting held March 13, 1984. D. RESOLUTION NO. 84 -2247 DENYING AN APPEAL FROM, AND CONFIRMING THE DECISION OF THE PLANNING COMMISSION IN THE MATTER OF MODI- FICATION OF CUP 71 -358 AND VARIANCE 83 -703 (Town & Country In- dustries, Southeast corner of Temple City Boulevard and Lower Azusa.Road) Adopted Resolution No. 84 -2247 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DENYING AN APPEAL FROM, AND CONFIRM- ING THE DECISION OF THE PLANNING COMMISSION IN THE MATTER OF MODIFICATION OF CONDITIONAL USE PERMIT 71 -358 AND VARIANCE 83 -703. RESOLUTION NO. 84 -2248 - DESIGNATION OF ADDITIONAL FEDERAL AID URBAN ROUTES Adopted Resolution No. 84 -2248 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPROVING THE REVISION TO THE FUNCTIONAL USAGE SYSTEM AND THE DESIGNATION OF AN ADDI- TIONAL FEDERAL AID URBAN ROUTE IN THE CITY. F. RESOLUTION NO. 84 -2249 WARRANTS AND DEMANDS Adopted Resolution No. 84 -2249 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $186,424.66 DEMAND NOS. 7330 THRU 7404. CONSENT CALENDAR ITEM C(2) - PROPERTY NUISANCE CASE 84 -109 (10721 Danbury) Councilwoman Swain felt that since the property owner had made an effort to clear the overgrown vegetation, it would be appropriate to extend the time in which to paint the premises. Councilwoman Swain moved to continue Property Nuisance Case No. 84- 109 to the April 17, 1984, Council meeting, seconded by Councilman Tyrell and unanimously carried. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: 7:30 P.M. STREET LIGHTING IMPROVEMENTS,- CAMELLIA AVENUE, SPARKLETT STREET TO LOWER AZUSA ROAD (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Manager Koski presented background information stating the City Council at their regular meeting held February 21, 1984, set public hearing for the installation of four street lights on marbelite poles with overhead service. The petition for the street lights was re- turned with the approval of property owners representing 88.527 of the front footage of the block. The total percentage exceeds the 60% requirement under Chapter 27 proceedings. The upgrading will require annexation into. Zone A of the Municipal Lighting District, and the property owners are aware of the difference in the zone rates. A Negative Declaration of Environmental Impact was prepared on Febru_ ary 14, 1984, in accordance with requirements of the California En- vironmental Quality Act. Property owners have been notified of to- night's public hearing. Mayor Gillanders declared the public hearing open and invited anyone wishing to speak to come forward. There being no one that came for- ward to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Tyrell and unanimously carried. Councilman Tyrell referred to the protest from one of the residents in the area who was concerned about the overhead wires. Following Council discussion, it was acknowledged that underground utilities, would be prohibitive in cost. Councilman Atkins moved to approve the Negative Declaration; find the project is in the best interest; adopt Resolution No. 84 -2250 A RES- OLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE CONSTRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO SECTION 5870 ET SEQ. OF THE STREETS AND HIGHWAYS CODE;. and instructed the Superintendent of Streets to initiate proceedings to annex the area into Zone A of the Municipal Lighting District, seconded by Councilwoman Swain and unanimously carried. B. REQUEST FROM TEMPLE CITY CHAMBER OF COMMERCE - "GOLD MINER DAYS" CARNIVAL, JUNE 29 - JULY 1, 1984 City Manager Koski presented background information stating when Council received the request from the Temple City Chamber of Commerce to conduct a carnival on the southwest corner of Las Tunas Drive in connection with the Gold Miner Days event, they requested the Traffic Commission evaluate potential traffic problems which may result. 1 Council Minutes, March 20, 1984 - 'I*age 3 Traffic Engineer Envall evaluated the; =proposal and concluded that there is sufficient access in and out of the lot and also sufficient parking in the CRA lot and the event would not adversely affect the traffic flow in the area. In reviewing a similar 1979 request by the center merchants to the Community Redevelopment Agency, the Agency approved the request subject to: approval by all businesses in the shopping center; a certificate of insurance in the sum of $5,000,000 which also included specific provisions of coverage; and a perfor- mance bond in the amount of $5,000 to guarantee against damage to the Public Parking facilities. Councilman Tyrell inquired as to the ramifications, if any, of Tip - Top not having signed the approval petition which was signed by all other businesses inthe CRA shopping center. City Manager Koski stated it was a courtesy petition which enabled the merchants to say yes or no, it was not a legal. requirement. Mike Eisner, who had circulated the petition, stated Tip -Top is an absentee landlord and the tenant spoke little English and could not communicate with him. Councilman Dennis moved to approve the "Gold Miner Days" carnival June 29 -July 1, 1984, subject to the Certificate of Insurance and specific provisions of coverage as outlined in staff memo of March 14, 1984, seconded by Co „Inc ,lman Tyrell and unanimously .carried. 7. NEWTBUSINESS :, None. 8. COMMUNICATIONS: A. COUNTY REGISTRAR - RECORDER REQUEST TO USE LIVE OAK PARK FACILITIES FOR POLLING PLACE FOR JUNE 5, 1984, PRIMARY Councilman Tyrell moved to approve the request from the Registrar - Recorder to use Live Oak Park for the June 5,' 1984, primary election, seconded by Councilman Atkins, and unanimously carried. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward to speak. RECESS TO CRA: At this time, Council recessed to meet as the Community Redevelopment Agency, approved the minutes of the regular meeting of March 6, 1984, and denied a request for a changeable copy reader board sign for Burger King Restaurant. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. I 11. MATTERS FROM CITY OFFICIALS: A. LIVE OAK PARK IMPROVEMENTS - ASBESTOS REMOVAL City Manager Koski referred to two change orders regarding the Live Oak Park"' improvement contract, One order for asbestos removal which . was encountered while installing vent fans in the auditorium and would constitute the reconstruction of the exterior wall and re- placement of necessary installation. The other change order would be relocating the receptacle in the auditorium to accommodate the . lowered ceiling, neither of which were part of the original contract. Council Minutes, March 20, 1984 - Page 4 Councilman Tyrell moved to approve the additional change orders in the amount of $3,747.85; authorized staff to have the work completed; and amended the contract accordingly, seconded by Councilman Atkins, and unanimously carried. B. TRAFFIC MANAGEMENT AT THE INTERSECTION OF MUSCATEL AND LONGDEN AVENUES Councilman Tyrell referred to petitions received from residents regarding the intersection of Muscatel and Longden during school_ hours and felt a crossing guard should be considered. Council - members concurred. Councilman Tyrell moved to authorize the employment of a crossing guard to assist in the movement of children crossing the inter- section going to and from school, seconded by Councilman Atkins and unanimously carried. 12. ADJOURNMENT: On motion by Councilman Atkins, seconded by Councilman Tyrell, the meeting adjourned at 7:55 p.m. Next regular meeting of the City Council will be held on April 3, 1984, in the Council Chamber of the City Hall.
