RESOLUTION NO. 16-9150
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA, DECLARING CERTAIN PROPERTIES
IDENTIFIED BY FOLIOS 08-2122-003-1690; 08-2122-003-1680; 08-2122-
003-1670 AS SURPLUS PROPERTY AND AUTHORIZING THE CITY
MANAGER TO DISPOSE OF THE PROPERTIES FOR PUBLIC
BENEFIT; PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, The City owns the following properties, identified by folio numbers
08-2122-003-1690; 08-2122-003-1680; 08-2122-003-1670; and
WHEREAS, Section 166.02(1), Florida Statutes and Resolution 08-7317 grant the City
Commission the authority to declare property that has become inadequate for public purposes as
surplus property; and
WHEREAS, The City Commission believes that it is in the best interest of the City to
declare the following properties identified by folio numbers 08-2122-003-1690, 08-2122-003-
1680, 08-2122-003-1670 as surplus and to dispose of the properties for public benefit.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission finds that it is in the best interest to declare the
above-referenced properties as surplus.
Section 3. The City Commission hereby authorizes the City Manager to dispose of
the surplus properties for public benefit.
Section 4. This Resolution shall take effect immediately upon adoption.

RE: Declaration of Surplus Properties Owned by the City of Opa-locka
The City administration has determined that the properties identified in the document attachment should be
declared as Surplus Property and therefore authorize the City Manager to Dispose of the properties for
Public Benefit.
Background
In December 2015, City staff updated a document of 44 City-owned properties by adding three additional
properties and the assessment information of the property value from the Miami-Dade County Property
Appraiser's Office for each property. In January of 2016, Planning & Community Development Staff
conducted a review of the information on City-owned properties identified to determine the potential fiscal
impact. A few of the properties were identified for parks and recreational or other municipal uses.
As of today, three more of the 47 properties have been identified as properties that the City of Opa-locka
presently has no intention to use and/or develop for a municipal use and that they are not in use for the
public benefit. It is in the public interest for the City of Opa-locka to sell or otherwise dispose of these parcels
in a manner to promote the best interests of the community. This determination is consistent with the
provisions of City Resolution 08-7317 and I have conducted a good faith evaluation and analyses and
therefore provide this written memorandum that these properties listed in exhibit A should be declared
surplus.
These three properties should be considered as assets to the City where these properties would be sold to a
for-profit entity for development. These three properties are not to be purchased and held as a means for
land banking. These property transactions will require a plan of action for development that must be
executed within a specified time-period.
No other properties owned by the City of Opa-locka are being considered for this process. The City of Opa-
locka should maintain a reverter position if formal plans to build on these properties have not been submitted
and construction commenced and/or the property developed according to the submitted plan within a 3-5
year period.

RESOLUTION NO.08- 7 317
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA, ESTABLISHING A POLICY FOR THE
DISPOSAL OF CITY-OWNED SURPLUS PROPERTY
WHEREAS, pursuant to Section 166.021(1), Florida Statutes, municipalities have the
power and authority to acquire and dispose of real property or interest therein for a municipal
purpose by means of an exchange of property, so long as such method of acquisition and
disposal of municipal property is for a valid municipal purpose and not expressly prohibited by
law; and
WHEREAS, the City Commission of the City of Opa-locka(`City Commission") desires
to establish a policy for the disposal of City-owned surplus property; and
WHEREAS, the City of Opa-locka further desires to establish a policy wherein the City
of Opa-locka can account for the sale,trade, donation and/or conveyance of real property and
other property declared surplus;and
WHEREAS, any property owned by the City which has become obsolete, or which has
outlived its usefulness, or which has become inadequate for the public purposes for which it was
intended, or which is no longer needed for public purposes, may be declared surplus property.
NOW,THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
