HomeMy Public PortalAbout2010.213 (10-05-10) RESOLUTION NO. 2010.213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD TO APPROVE SUPPLEMENTAL AGREEMENTS WITH GANNETT FLEMING TO CONDUCT ADDITONAL DATA GAP INVESTIGATIONS FOR SOUTHEAST 105 FREEWAY & LONG BEACH BOULEVARD USING FEDERAL BROWNFIELD GRANT FUNDS WHEREAS, the City of Lynwood approved the Long Beach Specific Plan to encourage development along its major commercial corridor; and WHEREAS, a major disincentive to development along this corridor is the potential existence of hazardous substances and petroleum contamination at various locations along this corridor; and WHEREAS, the primary source of the contamination for the Southeast 105 Freeway & Long Beach Boulevard is located at 11600 Long Beach Blvd.; and " WHEREAS, the City of Lynwood has received $400,000 in United States Environmental Protection Agency (USEPA) Grant funding to assess petroleum and hazardous substances; and WHEREAS, on June 16, 2009, the Agency approved Gannett Fleming to conduct a Data Gap Investigation in order to acquire an accurate bid for the cost to remediate the site and produce a Remedial Action Plan; and WHEREAS, amendments and or supplemental agreements may be required as additional environmentally hazardous conditions are discovered that require further investigation; and WHEREAS, there is a need to do additional investigation of the contamination in subject area to complete the remedial action plan and appropriately remediate the contamination known to exist in the area; and WHEREAS, due to the nature of discovery during data gap investigations, it is critical that work on these tasks begins immediately in order to remain within the timeline of the Remedial Action Plan; and WHEREAS, this may be achieved by authorizing the City Manager/Executive Director to approve amendments and supplemental agreements pertaining use of Federal Brownfield Grant funds. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City Council hereby approves the Supplemental Agreement with Gannett Fieming in the form presented to this Council to conduct additional data gap investigations for Southeast 105 Freeway and Long Beach Boulevard using Federal Brownfield Grant Funds. Section 2. The City Manager or his designee is hereby authorized to take necessary steps, including the execution of amendments and supplemental agreements with Gannett Fieming to undertake additional data gap investigations at the Southeast 105 Freeway & Long Beach Boulevard site, subject to the amount appropriated for this purpose of $400,000.
