THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 636 AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM "C-1" & "R-3" TO "R-5" ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. WHEREAS, The legal description of the tract of land is as follows: Legal Description Lot 4, Block B 22 Together with Lot 1, Block 23, Together with Reserve C of Central Park Addition, Bel Aire, Sedgwick County, Kansas, more particularly described as: BEGINNING at the northeast comer of said Lot 1,thence along the east line of said Lot 1 on a Kansas Coordinate system of 1983 south zone bearing of S01'56!16"E,941.40 feet to the southeast comer of said Lot 1.being coincident with the northeast most comer of Reserve H,Elk Creek Addition,an addition to Bel Aire, Sedg-Mck County.Kansas:thence along the southerly line of said Lot 1; being coincident with the northerly line of said Reserve H for the next two courses. WHEREAS, A public hearing was convened on the matter of rezoning the afore described tract on July 12, 2018, by the Planning Commission for the City of Bel Aire, Kansas in conformance with the requirements set forth in Article Five of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, Following the public hearing, the Planning Commission found that the evidence supported recommending approval of this requested conditional use request based upon the guidelines set forth in Article Five, Section Three (5.03) of the Zoning Regulations of the City of Bel Aire, Kansas, in association with the owner's request for R-5 multifamily housing complex which will not be contrary to the public interest or detract from the residential nature of the neighborhood; 1 WHEREAS, The Planning Commission for the City of Bel Aire, Kansas, recommends approval of the application by the owner, City of Bel Aire Land Bank, to change for the tract of land, as described above, from C-1 & R-3 to R-5; WHEREAS, the Governing Body has considered the factors set forth in Article 5.01 and Article 5.02 of the Zoning Regulations of the City of Bel Aire, Kansas BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: SECTION 1. The Governing Body accepts the recommendation of the Bel Aire Planning Commission, and approves the rezoning of the tract of land from C-1 & R-3 to R-5. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. This Ordinance shall take effect and be in force from and after its publication in the official City newspaper. Passed by the City Council this day of 2018.
