AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF MISSOURI CREDIT UNION SUBDIVISION, A SUBDIVISION
OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Missouri Credit Union, owner of the real estate hereinafter described, having
submitted to the City Council a plat of said real estate, being located in Jefferson City, Cole
County, Missouri, and being part of the Northwest Quarter of Section 21 and part of the Northeast
Quarter of Section 20, Township 44 North, Range 11 West, in the City of Jefferson, Cole County,
Missouri, more particularly described as follows:
Part Of Lots 2, 3, 4, 5, and 6, Of Schotthill Woods Subdivision Section One as per plat of
record in Plat Book 11, Page 145, Cole County Recorder's Office, a subdivision of part of
the south half of the Northwest Quarter and the north half of the south half of Section 21,
Township 44 North, Range 11 West, and part of Reserved Tract 'B', of Cypress Point
Subdivision Section II, as per plat of record in Plat Book 12, Page 51, Cole County
Recorder's Office, a subdivision of part of the Northeast Quarter of Section 20, Township
44 North, Range 11 West, in the City of Jefferson, Cole County, Missouri; more particularly
described as follows: From the southwest corner of Lot 6, of said Schotthill Woods
Subdivision, Section One; thence North 85 Degrees 43 Minutes 30 Seconds East, along
the southerly boundary of said Lot 6, 208.94 feet to the westerly right-of-way line of
Eastland Drive as described In Book 360, Page 942, Cole County Recorder's Office; thence
North 07 Degrees 55 Minutes 14 Seconds West, along the westerly right-of-way line of said

WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Final Subdivision Plat of Missouri
Credit Union Subdivision, that all taxes have been paid, that in all respects the requirements of
• Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said
subdivision, and that in all respects the requirements of the Planning and Zoning Commission of
the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
• MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Missouri Credit Union Subdivision, lying,
being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the
said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by
the City Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P08024— 904 Eastland Drive, Final Subdivision Plat of Missouri Credit Union
Subdivision. Application filed by Missouri Credit Union, property owner, Harold James,
authorized representative, for a final plat of 2.87 acres on land zoned C-1 General
Commercial. This proposed final plat includes two commercial lots. The property is located
on the Southwest corner of the intersection of Eastland Drive and East Elm Street. The
property is described as part of the Northwest Quarter of Section 21 and part of the
Northeast Quarter of Section 20, Township 44 North, Range 11 West, Jefferson City, Cole
County, Missouri. (Central Missouri Professional Services, Consultant).
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request and explained that the subject property was rezoned to C-1 General
Commercial in April, 2007. He stated that the applicant proposes a two lot subdivision, which will
eliminate the existing duplex located on the subject site.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that no new streets are
proposed by the subdivision and that the two proposed lots have existing street frontage on
Eastland Drive and Lot A has existing frontage on East Elm Street. He stated that sidewalks will
be required along Eastland Drive and East Elm Street.
• Mr. Wade gave the Engineering Division staff report and explained that infrastructure exists
to serve the subdivision and no new improvement plans are necessary for the subdivision at this
time. He stated that street lights and fire hydrants currently exist along Eastland Drive and East
Elm Street.

Mr. Bickel moved and Mr. Jordan seconded to recommend approval of the Final Subdivision
Plat of Missouri Credit Union Subdivision to the City Council, subject to the following conditions:
1. Compliance with the comments and technical corrections by the Engineering Division;
2. Compliance with the sidewalk requirements as outlined in the City Code.

• Case No. P08024 — 904 Eastland Drive, Final Subdivision Plat of Missouri Credit Union Subdivision and
Replat. Application filed by Missouri Credit Union, property owner, Harold James, authorized representative, for a
final plat of 2.87 acres on land zoned C-1 General Commercial. This proposed final plat includes two commercial
lots. The property is located on the Southwest corner of the intersection of Eastland Drive and East Elm Street. The
property is described as part of the Northwest Quarter of Section 21 and part of-the Northeast Quarter of Section 20,
Township 44 North, Range I 1 West,Jefferson City,Cole County,Missouri. (Central Missouri Professional Services,
Consultant).
BacklZround
A proposal to rezone this property from a combination of Single Family, Duplex, and PUD zoning to C-1
Neighborhood Commercial was heard by the Planning and Zoning Commission on April 12, 2007. A number of
concerns were brought up by neighboring landowners, including the impact of a proposed relocation of East Elm
Street to the western and southern portions of the property, and the rezoning case was recommended for denial to the
City Council.
The rezoning proposal proceeded to the City Council and was initially tabled after many concerns were
expressed about the proposed development and future roadway connection. A development agreement between the
City and the owner of the property was drafted in order to address many of these concerns, including driveway access
to the property, landscaping requirements, and the transfer of a portion of the property required for the future
relocation of East Elm Street. A separate agreement between the owner of the property and the homeowners
immediately adjacent to the proposed roadway relocation was also put into place. This private agreement transferred
portions of the property required for the Elm Street relocation to the neighboring landowners and arranged for the
landscaping of the area. With these agreements in place, the City Council approved the rezoning application to C-1
Neighborhood Commercial.
A pair of parcel divisions dividing the western and southern edge of the rezoned property into individual
tracts to be deeded over to the neighboring landowners and a larger tract that was deeded to the City of Jefferson for
the future Elm Street relocation was administratively approved in August of 2007.
Description of Proposed Plat
Zoning: C-1 General Commercial
Size of Property: 2.87 Acres
Number of Lots: 2
Lot Sizes: Lot A— 1.54 acres
Lot B— 1.33 acres
Streets: No new streets are proposed by the subdivision, the two lots have existing street frontage on Eastland Drive
and Lot A has existing frontage on East Elm Street.
Sanitary Sewer: Both lots are adequately served by existing sanitary sewer service improvements.
Sidewalks: Sidewalks will be required along Eastland Drive and along East Elm Street.
Staff Recommendation
Staff recommends approval of the subdivision plat subject to the following:
1. Compliance with the comments and technical corrections by the Engineering Division.
• 2. Compliance with the sidewalk requirements as outlined in the City Code.

ENGINEERING STAFF RECOMMENDATION-
Support approval of the proposed subdivision plat.
Infrastructure Summary
* Infrastructure exists to serve the subdivision. Streets, storm sewers,and sanitary sewers exist to
serve the subdivision. No new improvement plans are necessary for the subdivision at this time.
Storm Water/Erosion Control
* Storm water and erosion control plans will be reviewed as part of future site plan development
for the proposed lots.
Sanitary Sewer
* The development is served by sanitary sewer.
Sidewalk
* Sidewalk will be required as a part of site plan development for the proposed lots.
Streets /Traffic Impact
* Eastland Drive is a two(2) lane northbound, one(1)lane southbound roadway with a center turn
lane along the frontage of the proposed subdivision, no parking allowed. East Elm Street is a two
(2) lane roadway with no center turn lane except for at the intersection, no parking allowed.
* The development agreement referenced in the Planning Division Staff Report and on the plat
indicates that the proposed lots will be subject to specific limitations for driveway access.
Fire Hydrants /Street Lights
* Facilities currently exist along Eastland Drive and East Elm Street.
•
