Member Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 00-44
RESOLUTION ORDERING PREPARATION OF
ASSESSMENT ROLL AND SETTING HEARING ON
PROPOSED ASSESSMENT FOR THE MOHAWK DRIVE
SANITARY SEWER AND WATER MAIN IMPROVEMENT
WHEREAS, on May 18, 1999 the city council authorized entering into a contract for the
making of the Mohawk Drive and Chippewa Road sanitary sewer and water main improvement;
and
WHEREAS, the cost for said improvement has now been determined and it is the desire of
the city council to assess benefited property owners for some or all of the cost of said improvement.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. The portion of the cost of such improvement to be paid by the city is determined to
be }�R, 6SS and the portion of the cost to be assessed against benefited property owners is

2. The assessments shall be payable in equal annual installments extending over seven
years, the first installment to be payable on or before the first Monday in January, 2001 and shall
bear interest at a rate of 8% per annum from the date of the adoption of the assessment resolution.
3. The administrator -clerk -treasurer, with the assistance of the consulting engineer,
shall forthwith calculate the proper amount to be specially assessed for such improvement against
each assessable lot, piece or parcel of land within the affected area, without regard to cash
evaluation, as provided by law, and shall file a copy of such proposed assessment roll at city hall for
public inspection.
4. A hearing regarding such assessment shall be held on October 17, 2000 in the
council chambers at city hall beginning at 7:30 p.m. (or soon thereafter) to pass upon such proposed
assessment. At such time and place all persons owning property affected by such improvement will
be given an opportunity to be heard with regard to such assessment.

5. The administrator -clerk -treasurer is hereby directed to cause a notice of the hearing
on the proposed assessment to be published in the official newspaper at least two weeks prior to the
hearing and to state in the notice the total cost of the improvement. The administrator -clerk -
treasurer shall also cause mailed notice to be given to the owner of each parcel described in the
proposed assessment not less than two weeks prior to the hearing.
6. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment of such property, with interest
accrued to the date of payment to the administrator -clerk -treasurer, except that no interest shall be
charged if the entire assessment is paid within 30 days of the adoption of the assessment. Any
owner may at any time thereafter pay to the administrator -clerk -treasurer the entire amount of the
assessment remaining unpaid, with interest accrued to December 31, to the year in which such
payment is made. Such payment must be made before November 15 or interest will be charged
through December 31 of the succeeding year.

The motion for the foregoing resolution was duly seconded by member Zietlow and upon vote
being taken thereon, the following members voted in favor thereof:
Ferris, Johnson, Lane, Smith, and Zietlow
and the following members voted against same: None
Whereupon said resolution was declared duly adopted.
