HomeMy Public PortalAbout1986-02-25 MeetingCOUNCIL MINUTES February 25, 1986 The Council of Bal Harbour Village met Tuesday, February 25, 1986 at 9:30 A. M. in the Village Hall. Present: Mrs. Antiles, and Messrs. Laikin, McKeehan, Sherman and Taplin. Also present were Louise Miller, Village Manager; Mary Wetterer, Village Clerk and Richard Weiss, Village Attorney. On motion of Mr. Laikin, seconded by Mrs. Antiles and unanimously voted the minutes of January 28, 1986 were approved as submitted. Mayor Sherman said that at the last meeting on petition of 75% of the residents in the proposed security district, a Resolution had been passed setting up a special assessment district. This Public Hearing is to discuss the proposed assessment roll. He said Mr. Gavigan had complained to Governor Graham's office stating that the petitions were improper, the assessment unfair, and that due to the nature of the service it should be included in the budget and done on an ad valorem tax basis. The Governor's office told Mr. Sherman that they found nothing illegal. Mrs. Miller said she had spoken to the Civic Association regarding access through the gate for the residents of One Harbour Way at the request of Mr. Burroughs, the condominium pres- ident. The Civic Association said that their residents would be given stickers for their cars. Also residents at the Bal Harbour Manor will have to be provided for as they must pass through the gate to reach their property. As there were no further comments from those present, Mr. Weiss said it was in order to pass Resolution No. 304 and close the issue. It was moved by Mr. Taplin, seconded by Mrs. Antiles and unani- mously voted that RESOLUTION NO. 304 confirming the special assessment roll for security purposes through September 30, 1986 be adopted. Mr. Weiss said at the last meeting changes were made in the proposed smoke de- tector ordinance to provide for a $75.00 first time inspection fee, make it applicable to four or more story apartment buildings, and add a penalty clause based on a per day basis. Mr. Wassel of the Singapore Hotel said he objects to the ordinance as they have smoke detectors in all the rooms. It was explained that detectors must be hooked to a panel in the lobby for instant monitoring. Mr. Taplin said the ordinance should apply to hotels also and we should not wait until the State mandated installations in several years. Mr. Weiss explained that the ordinance as advertised for passage today is only for apartment buildings over four stories. He said he would research the re- quirements as they would pertain to hotels for the next meeting and the ordinance could be amended. It was moved by Mr. Taplin, seconded by Mrs. Antiles and unanimously voted to pass on final reading ORDINANCE No. 275 providing for smoke detectors hooked up to an annunciator panel in apartment build- ings over four stories. Mr. Gavigan asked if the Public Hearing was being held. Mr. Weiss explained that the Hearing was scheduled for 9:30 A.M., was held, and Resolution No. 304 was passed. The Assessment Roll has been confirmed. It was agreed to hear Mr. Gavigan. Mr. Sherman said he wishes to inform Mr. Gavigan that Mrs. Rodriguez from Governor's Graham's office had called to advise that Bal Harbour is not in violation of any State Law. Mr. Gavigan stated his objection as the assessments could be put on the tax roll; all other such February 25, 1986 assessments in Dade County pertain to single family properties, are a one-time assessment for something like a gate house construction; and the Florida Statues 170.01 prohibit this type of assessment. Mr. Weiss told Mr. Gavigan that we are aware of the Statues and are comfortable with our actions. This has all been gone through and we are in conformance. The Village has authority to do this. Mr. Sherman said we know that Mr. Gavigan does not agree with us, however, the Hearing took place at the scheduled time. The Village Clerk read Ordinance No. 276 adopting a policy for payment of judge- ments against certain public officials. Mr. Gavigan said he objects to this and the matter should be voted on by the electors. It was explained that four Dade County cities have already passed such an ordinance and that three have it in the works. There is a real need for this as it fills a void due to a gap in insurance now being offered. It was moved by Mr. McKeehan, seconded by Mrs. Antiles and unanimously voted that ORDINANCE NO 276 be passed on final reading. Mr. Sherman said that the proposed ordinance on demolition of buildings would prevent repetition of a "Beau Rivage job". Mr. Weiss explained sections of the or- dinance. Mrs. Miller said she had visited the Beau Rivage property with their attorney and they are working with George Desharnais to finish the job and put the property in order. Ms. Wetterer read the proposed ordinance by title for first reading. On motion of Mr. Taplin, seconded by Mr. McKeehan and voted the ordinance was adopted. Mrs. Miller said that the police contract has been renegotiated regarding com- pensatory time based on the amendment to the Fair Labor Standards. It now includes combining holiday banked time and compensatory time. The union hs accepted and ratified it. It was moved by Mr. McKeehan, seconded by Mrs. Antiles and unanimously voted to approve the renegotiated contract. Mr. Weiss said the PBA attorney had called him and asked that the current proposed pay vs banked pay be specified in the contract. The council agreed to this provision. Mayor Sherman introduced Mr. Matthew Mathes of Reynolds, Smith and Hills. Mr. Mathes said the update of our Comprehensive Plan was completed and submitted to the designated State and local agencies. The next step is to hold a Public Hearing on the updated plan. There are two other items which must be addressed. One, a capital improvement plan and the other, provisions for site development for group homes, adult congregate living facilities. It was suggested that there are no sites available for group homes that a request be made to the State to exempt Bal Harbour from this pro- vision. A new proposal covering the cost of the Capital Improvement section could be requested from planners, or the Village might be able to do this in-house. The Public Hearing to consider the update of the Comprehensive Plan was set for 9:30 A.M., March 25, 1986. Mr. Sherman said that Dade County had negotiated for the Regis Philbin Show to be broadcast from the Sheraton Hotel February 24-28, 1986. Dade County was contribut- ing $50,000; Bal Harbour $10,000; and Bal Harbour Shops, $5,000; and the Sheraton $5,000 plus rooms and food. Mr. Alden from the Sheraton said the first reports showed an audience of 1,000,000 watching the show in New York. It was moved by Mr. McKeehan, seconded by Mrs. Antiles and unanimously voted that Bal Harbour's execution of the contract and $10,000 expenditure be ratified. Mr. Sherman said that Bal Harbour made a $250,000 contribution to the Greater Miami Convention Bureau and is asking the County for more events such as this which brings a return on our investment. Mrs. Miller said a title search is being done on property north of the Sun Bank to see if the bank can contribute to the mini -park. The Florida Department of Trans- portation is also seeing what they can contribute. February 25, 1986 The Village Manager said that we are trying to book conferences, etc. to the area and were looking for a special events coordinator under a public rela- tions firm. Nine people and firms had expressed interest. From these she be- lieves Hank Meyer's firm would be the best as he has an excellent reputation and staff and is familiar with Bal Harbour. His fee is $4,000 a month and she recommends a six month contract. He would coordinate with the Resort Tax Advisory Committee. We have money available. Mr. Sherman said the Committee had a meeting yesterday and most properties recommended negotiating with Hank Meyer. It was moved by Mr. Taplin, seconded by Mr. McKeehan and unanimously voted that Bal Harbour enter into a contract for six months with Hank Meyer Associates, Inc. and to see if he would lower his fee. Mrs. Miller said Mr. Martinez, electrical engineer, had checked the Collins Avenue lighting and said we need three more light poles. Two at the Sheraton and one at the Sea View. We can do this with our own staff. The Manager reported that St. Francis Hospital had sent their mobile unit and thirty five employees had taken advantage of their checking blood pressure and for glaucoma. Mr. Sherman said that the second annual Beautification Dinner would be held at the Sea View Hotel on April 3rd and Ralph Renick would be the Master of Ceremonies. Mr. William Whitman said that the government mail box at the Yacht Club has rusted out. Also that Bal Harbour is a Bird Sanctuary and the crows are doing away with all our song birds. Mayor Sherman asked Mr. Whitman to work with Mrs. Miller on this problem. Mr. Weiss said he would like to introduce Ms. Andrea Karns, an attorney in the firm who has been doing some of Bal Harbour's work.
