GOV PIRE ' S � ER Btffl CLERK BOARD OF HEALTH MEETING WEDNESDAY MARCH 7 , 2018 AT 7 : OOPM TOWN HALL, ROOM B Board members present : Carmen Scherzo, DVM, Chairman ; Mary Chaffee, RN, PhD, JD and Annette Graczewski (ASCP) Others present : Nancy Ellis Ice, CHO, RS, MPH, Health Director and Tammi Mason, Senior Department Assistant L Chairman ' s announcements The VNA in conjunction with the BOH will hold a child and adolescent lead screening and immunization on March 19, 2018 , 11 : 30AM — I : 30PM at VNA offices in South Dennis . Appointments are required . Residents can call 508 - 957 - 7423 . The VNA in conjunction the BOH will hold a Glucose, Blood Pressure and Cholesterol screening at the Brewster Ladies Library on March 27, 2018 from I O : OOAM — 2 : 00PM . Due to storm damage, the transfer station will be accepting brush, storm limbs and debris until Sunday. Fees will be waived . Mrs . Ice appeared before the Finance Committee and they accepted the 2019 budget. 2 . J.M. O 'Reilly & Associates , Inc . — Title 5 variance requests for 470 Underpass Road John O 'Reilly and Bob Reedy presented this to the Board . This is a failed Title 5 septic system . The owners will be installing a complete new system . They are looking for a Depth variance for 12 inches . Mr. O ' Reilly stated that they are basically locked in on this property due to a concrete slab in the commercial bay. Site is very flat . A vent will be provided and there is no expansion of flow. Mrs . Ice asked if the components would be H2O . Mr. O ' Reilly stated that they would be . Motion : Finding that this will be an improvement over what is there, a vent will be provided and there is greater than 6 feet of separation to groundwater, grant the 12 " variance request, Motion : Annette Graczewski Second : Mary Chaffee Vote : 3 - O - O Action : Motion carried 3 . J.M. O ' Reilly & Associates , Inc . — Title 5 and local variance requests for 60 Hazel Lane John O ' Reilly and Bob Reedy presented this to the Board . Mr . O ' Reilly told the BOH that they may have received a plan that does not show edge of wetland on it. This is a failed septic . They will be replacing the failed leaching pits . This is a 3 bedroom home and is a simple upgrade . There is no increase in flow. They are trying to maintain 10 feet to bulkhead and foundation . The following variances are requested : 1 . To allow the proposed SAS to be 10 feet from foundation wall 2 . To allow the proposed SAS to be 3 feet from the property line 3 . To allow the proposed SAS to be 81 feet from the inland vegetated wetland Mr. O ' Reilly stated that they did not hit water during soil testing and there is 12 feet to bottom of test hole 1 . WWW. Reedy stated that there was a neighbor to the North and he does not know where their septic is . Mr. O ' Reilly stated that there are mostly woods on that side of the house . Dr . Scherzo stated that groundwater flow is to the North and flowing away from the pond . Conservation Commission has given approval for this project. Motion : Finding that this is an upgrade to the current system, there are multiple design limits with the lot, groundwater is flowing away from the pond, Conservation has given approval and an HDPT liner is going to be used, approve the variance requests requested (proposed SAS to be 10 ' from foundation wall, proposed SAS to be 3 ' from property line and proposed SAS to be 81 ' from the inland vegetated wetland) Motion : Mary Chaffee Second : Annette Graczewski Vote : 3 -0-0 Action : Motion carried 4 . J.M. O ' Reilly & Associates , Inc. — Local variance request for 75 Johnson Cartway John O ' Reilly and Bob Reedy presented this to the Board . A septic inspection was done for the sale of the home . The system was found to be in good working order with the exception of a few minor repairs . The system was installed in 1983 . The leach pit is 154 ' away from the edge of the pond . There is 20 feet from groundwater to the bottom of the leaching pit . Groundwater flow is towards the pond . Mr. O ' Reilly stated that he did sketch out a 4 bedroom new system, but they only gain 10 feet to the horizontal distance to the pond . Basically the whole property is in the 300 foot zone . A 146 foot variance from the leaching pit to the pond is requested . Mrs . Graczewski asked how deep underground the leaching pit was . Mr. Reedy stated that it was 14 feet . Dr . Scherzo stated that he has a problem with this leach pit. He would like to see an I/A system or a new conventional system be installed . Mrs . Graczewski is concerned about the age of the system . Motion : Because of the age of the system and concerns raised about the pond and groundwater flow, deny the variance request, Motion : Annette Graczewski Second : Mary Chaffee Vote : 3 -0-0 Action : Motion carried 5. J.M. O 'Reilly & Associates, Inc. — Discuss the monitoring well fence at the Villages (Ocean Edge) John O ' Reilly and John Mostyn (Attorney for Ocean Edge) were present. Attorney Mostyn stated that he was unaware of why the monitoring wells were even there . Reporting stopped in December of 2015 . One of the monitoring wells was damaged due to landscaping debris being placed there . Information was sent to DEP about this well . DEP does not review the information and doesn ' t know the basis of why these wells are required . Attorney Mostyn went over some history of this . He stated that basically this came about because of the full scoped Environmental Impact Review (EIR) of the entire Ocean Edge project ordered by DEP . In 1992, that full scoped EIR was deemed unlawful . The court ruled that the EIR should have been limited to the bridge over the bike path and should not have included the waste water impacts at Ocean Edge . He doesn ' t really have anything to go back to his superiors with why this needs to continue . Dr . Scherzo asked about the Oct 6, 1992 nitrogen issues and asked where the nearest septic system was to the monitoring well in question . Mr. O ' Reilly stated it was about 250 feet downgradient and 950- 1000 feet up gradient . BOH 3 /7/ 18 Minutes Page 3 There was discussion on this issue . Motion : Do not require Ocean Edge to reinstall the monitoring well or continue to monitor the existing monitoring fence . Motion : Mary Chaffee Second : Annette Graczewski Vote : 3 -0-0 Action : Motion carried 6 . Paul Frederick Leland — 21 Henry ' s Road — trash complaint Owner was not present but did drop off a note stating that he would take care of the trash by March 111" . CS -fine his $ 100 if trash is not removed by March 151" . Fine will be given the day after . AG-thinks we should answer his letter and say that he has to next week and we will do a check. Motion : Have Mrs . Ice explain to Mr . Leland that the Board of Health did discuss the issue and his letter stating he would have all the trash and debris removed by March 11 t" . The inspector will go back out on March 12"' to re-inspect . If the yard is not cleaned up the Board will either institute fines of up to $ 500 per day for every day the yard is not in compliance and the Board may move forward with court action . Discuss the Design , Operation and Maintenance of Wastewater Treatment Facilities regulation There were a few minor changes requested . Mrs . Graczewski will make the changes and bring back again for review. 8. Discuss the Water Quality Report regulation Mrs . Graczewski asked Mrs . Ice how she is currently using this regulation . Mrs . Ice stated that it is used very rarely . Dr . Chaffee stated that she thought the title of document made no sense . Dr . Scherzo gave a little history of this regulation . Dr. Chaffee though that the guidelines that are attached to this regulation should be incorporated into the actual regulation . The Board asked that Mrs . Ice merge these into one regulation and highlight the nitrogen measurements that are inconsistent. 9. Discuss the March 21 , 2018 meeting The Board agreed to cancel the meeting . 10. Topics the Chairman did not anticipate None . Informational items were noted Meeting adjourned at 8 : 35PM ,
